G. The Pro�e�t, v�hic� is described and �llustrated on the Arden ���iage <br />Redevelopment Planned Docur�en�s, is hereir�after referred to as �he "Arden <br />Village Pro�e�t'�. <br />3.0 Citv Pianning Commission Re��ew and Recorr��nendations. On the 9�h day of <br />Decembe�, 2fl09, at a public hea�-ing, the Arden Hi��s �'�anning Comrn�ssion <br />considered the Arden Village A�plication, the repo�ts a�d com.ments of the ��t� staff <br />and consultan�s, reports and co�men�s of Arder� Village, and ot�er publi� <br />cornments; and, subject �� cond�ti�ns, reco�nmended approval of: the Arclen �T��lage <br />App�ication. <br />4.0 Cit� Council Review. On the 8th day of March, 201�, the City Council revievved the <br />Arde� �iillage App��cation, the re�orts and rec�mmendations of t�e �ity staff and <br />cons�ltants; the rep�rts an�d requests o� Ar�le� Vil�age; a�d the r�commendatio�s of <br />the Cit� Pla�ning Con�r�issi�n; and, sub�ect to the conditions conta��ed h�r�in, <br />approved �he Arden Vi�lag� Applicatior�. <br />5.0 Terms and Conditions. in considera�ion of the Cit�r's deve�op�ent approvals; i� <br />compliance w�t� t�e City's development regulatio�s; and in consideration �f the <br />undertakings expressed herein, the parties agree: <br />A. Planne�l Unit Develo�ment. <br />1. �'he Arden Village Project shall be completed in accordance �vith the <br />Arden Village Redevelopmen� Plan Documents as amended by the <br />conditions of approvai. Any signif�cant c�ange to the Arden V�llag� <br />Redevel�pment Plan Do�uments, as �ietermined by the C�ty ��an�er°, <br />shall require reviev� by the City P�anr�ing Com�nission; and review <br />and approval by the City Council. <br />2. Arden Villa�� shall obtain building permits on or �efore �une 3�, <br />2�11, or the PUD Plan approval shall expire unless extended �� the <br />City Counci� prior to the approvalis ex�iration date. Extensior� <br />requests s�all be submitted in writing to t�e City staff at �east �� da�s <br />prior to the expiration date. <br />B. Final P�at. <br />1. Arden Village shall file the Final Plat with Ra�nsey �ounty on or <br />before March 8, 201 i, or, prior to �he �ssuance of any building pe�-m�ts <br />for the Arden Village Project, whi�hever event occurs first. <br />C. Condit�o�al tlse Perm�t Amendn�ent. <br />1. The existing com�nunicat�on tower shall be brought into compliance <br />with Conditiona� Use Permit 72-�24, or an amended CUP, pr�or to the <br />3 <br />
