ARDEN HILLS CITY COUNCIL—March 8, 2010 6 <br /> 6.A. Planning Case #09-021 Arden Village, LLC (Jamie Thelen) 1296 County Road F — <br /> Conditional Use Permit Amendment, Rezoning, and Comprehensive Plan Amendment, <br /> Preliminary and Final Plat, and Master and Final Planned Unit Development(continued) <br /> Mr. Thelen stated that their internal policy is no more than two people per bedroom but they <br /> would also follow any City Ordinances that may be more restrictive than this. Sand Companies <br /> has enforced this in other developments as well. <br /> Mayor Harpstead asked if it was possible that students would be living in this facility. <br /> Mr. Thelen stated that this housing development was not designed for students and there are <br /> restrictions on students living there. <br /> Councilmember McClung asked Mr. Thelen to review the concerns brought forward by the <br /> neighboring businesses. <br /> Mr. Thelen stated that he had met with Boston Scientific, Land O' Lakes, and Bethel University. <br /> v <br /> y <br /> Land O'Lakes expressed concerns with complaints about noise, trespassing, and resident <br /> complaints. Sand Companies discussed possible fence options with Land O'Lakes. This option <br /> would help to deter people from trespassing onto the Land O'Lakes property. Sand Companies <br /> also discussed paying to have a fence put up around the cooling tower located on the Land <br /> O'Lakes property. During the construction of the facility, Sand Companies is willing to install <br /> p g <br /> windows and patio doors with a STC rating of 32 to reduce sound. Sand Companies will also add <br /> an addendum to the lease agreement with residents that will specifically outline there will be noise <br /> from the area businesses and trespassing on these properties will be an infraction on the lease. <br /> Councilmember Holden stated Land O'Lakes, Boston Scientific, and Bethel University have <br /> been in this commercial/industrial area for several years and they have based their businesses and <br /> future expansions in this area on the fact that this is zoned commercial/industrial. People will <br /> come forward with complaints about the noise and the businesses should not have to be concerned <br /> about this. <br /> Mr. Thelen stated that when people are at the site to view the apartments they would see the area <br /> and understand that there will be noise. This will also be specifically outlined in the lease <br /> agreement. <br /> Councilmember Holmes clarified that the Arden Village would not be encroaching on the <br /> neighboring businesses ability to expand. <br /> Mayor Harpstead opened the public hearing at 7:50 <br /> Mr. Marcia Droege, Director, Facilities and Office Operations for Land O' Lakes, stated Land <br /> O'Lakes owns forty-three acres in this area and they do plan to expand in the future. She stated <br /> that Land O'Lakes does have activity that extends beyond normal business hours and these <br /> projects may not only be noisy but they may also produce odors that are unpleasant to residents. <br /> These activities have been done in the past without concerns for neighboring properties because <br /> they are in an industrial area. Land O'Lakes is also concerned about the safety of the residents. <br />
