The Ci�y of Arden Hi1�'s Zon�ng Code is adopted by reference and rnade a <br />pa� of this Section �s if set o�t i� fu�I. <br />1335.�5 Regulatory F�ood Protect�on Elevatian. `�e Regulatory Flood Protectian E�e�a�io� shall <br />be an ele�atio� no �ovver thar� one fo�t abov� the elevat�on of the regional f�ood plus any �ncreases in <br />floc�d e�evat�on caused by eneroach�nent� on t�e floot� pia�n t�at resul� fram des�gnation �f a <br />flood�vay. <br />1335.Ob Lands to V�i�ic� Regulations Ap�ly. Minneso�a tAll Jurisdictions} and F�ood Insuranee R.ate Map panels therein numbered <br />27 ��3C0004G, 27123Cd�O5G, 2712�C001 �G, 27 I 23C0012C, 27123C001 �G and 27 ��3C�02�G, <br />all dated June 4, 24 � 0, and prepared by �he Federal Ern�r�enc}� 1Vlanagement �g�ncy. The �f�c�a� <br />Zoning Map shal� be on f�e in the Off ce of the City Adrr�inistrator. <br />1335.08 <br />� 335.18 In�erpretat�on. <br />Subd. 1 IVlinimum Standa�ds. In their in�erpreta�ion and appliea�ion, these reg�.lations <br />of this Section shal� be held to be minimum req�irements a�d shall be �iberally eon���ed <br />�n favor of the �ity and shall not be deeme� a�imitation or repeal of any otl�er powers <br />grar�ted b� �tate Stat�tes. <br />Subd. 2 Boundaries. The boundaries of the zon�ng districts sha�1 be deierrnined by <br />sca�ing c�istar�ces on the Official 2oning Ma�. �1Vhere interpretation is needed a� to the <br />exact location of the boundaries of the district �s shown on the ��ficial Zoning 1Via�, as <br />for exampie where t�ere appears to �e a conflict between a mapped �oundary a�d actua� <br />�eld conditions and there is a forma� appeal o�t�e decisian of t�e Zoning Admin�strator, <br />the Board of Ad3ustment shall make the necessary in��rpretation. Ail decisions sha�l be <br />based t�n e�evations on the regional ( I OQ-year} fl�od prof le, ��e ground elevatior�s �hat <br />existed on �he si�te a� the time the Gity adopted ��s initial floodplai� ordinance or on t�e <br />date of t�e f rst I�Ia�ional Fiood I�s�rance �'rogra� map showing the 1 OQ-year �oodplain <br />if ear�ie�-, and ot�er avai�able technical data. An� person contesti�g t�e location of t�e <br />dist��t �oundaries shall be gi�en a reasa�able oppor�unit}� to present �is or her case to <br />�he Board and to submit technical evidence. <br />1335.19 Abrogatian and Greater �Zestrictio�s. It is not i�tended by this �rdir�ance �o re�eai, <br />abro�ate, or impair a�y existing �ase�ne�ts, covenants, or deed r�st�ictions. �owever, vvhere ���s <br />�rdinance i�n�oses greater restrictions, �he provis�ons of this Ordinance shall �reWai�. All o�her <br />o�din�nces �nconsistent ��v�th this 4rdinance are herebyre}�ealed t� the exte�t �fthe �n�t��sis�ency <br />on�y. <br />
