In lieu of the dedication of the land for recreational purposes, the City Council may <br />require the developer to pay to the City, as an equivalent contribution, an amount in cash <br />equal to the percentage of the land required to be dedicated, multiplied by the fair market <br />value of land remediated to MPCA Tier II Residential SRV. The park dedication may be <br />divided between a land dedication and cash contribution at the discretion of the City. <br />Option 4: House of Worship <br />Staff contacted Jean Coleman, the attorney working with the Cuningham Group, <br />regarding the House of Worship use on the land use chart. The proposed regulations do <br />not list House of Worship as a permitted use in the MB or MR Districts. Ms. Coleman <br />expressed concern about not allowing House of Worship in those districts. She is <br />preparing a letter for the Council explaining her concern. The letter was not ready in <br />time for this printing; however, staff will provide it upon receipt to the Council. She <br />recommends that the City reconsider allowing House of Worship as a permitted use on <br />the land use chart. <br />�indin�s of Fact <br />The Planning Commission offers the following findings of fact for this proposal: <br />l. The proposed Mixed Residential (MR) and Mixed Business (MB) advance the vision for <br />the TCAAP reuse area stated in the 2030 Comprehensive Plan. <br />2. The proposed MR and MB zoning districts are in conformance with the 2030 <br />Comprehensive Plan Future Land Use Map. <br />3. The proposed uses in the MR and MB zoning districts are in conformance with the 2030 <br />Comprehensive Plan future land use categories. <br />4. The proposed density for the MR district is in conformance with the 2030 <br />Comprehensive Plan future land use category. <br />5. The proposed zoning additions and amendments are in keeping with the spirit, purpose, <br />and intent of the City's zoning regulations because it promotes the general welfare, public <br />health, safety, and comfort of the inhabitants of the City. <br />Recommendation <br />The Planning Commission recommends (6-1) approval of Ordinance 2010-010 in Planning Case <br />10-009 amending Sections 1305.04, 1315.01, 1320.04, 1320.05, and 1320.06 of the City Code <br />and adding Section 1320.135 to the City Code regarding the TCAAP Zoning Regulations as <br />presented in the June 28, 2010, report to the City Council, and the authorization of publishing a <br />summary of Ordinance 2010-010. <br />City of Arden Hills <br />City Council Meeting for June 28, 2010 <br />�VVletro-inet. us�ardenhills�Planning\Community Development\TCAAP\Planning - Public Auction�Land Use Planning�7'CAAP Land Use <br />Regulations - Memos\062810 - CC Meeting\062810 - CC Memo - TCAAP Planning Process.doc <br />Page 9 of 10 <br />
