-----AV � <br /> ENHILLS <br /> MEMORANDUM <br /> DATE: September 8, 2010 PC Agenda Item 3*A <br /> TO: Planning Commission <br /> FROM: Meagan Beekman, City Planner <br /> SUBJECT: Planning Case#10-009 -This application requires a PUBLIC HEARING <br /> Applicant: 1201 County Road E LLC (TAT Properties LLC) <br /> Property Location: 1201 West County Road E <br /> Request: Zoning Code Amendment, Preliminary and Final Plat, Master and Final <br /> Planned Unit Development <br /> Requested Action <br /> The applicant has requested a Zoning Code Amendment, Preliminary and Final Plat, and Master <br /> and Final Planned Unit Development(PUD)to allow the existing student housing facility located <br /> at 1201 County Road E, the former Holiday Inn site, to convert from an interim to a permanent <br /> use. <br /> Background <br /> 1. Overview of Request: <br /> In March 2008 the City approved a request from TAT Properties and Northwestern College <br /> granting an Interim Use Permit (IUP) at the former Holiday Inn property that would allow <br /> the College to operate a student housing facility in the B-2 District. TAT Properties had <br /> purchased the building and intended to lease it to Northwestern College. The IUP is set to <br /> expire May 30, 2011. Student housing is currently defined as "institutional housing" in the <br /> City's Zoning Code. As part of the approval the City adopted an IUP process, and amended <br /> the City's land use chart to allow institutional housing as an interim use in the B-2 District, <br /> under certain circumstances. <br /> At the time of the IUP approval the City was just beginning the process of developing the <br /> Guiding Plan for the B-2 District, which was ultimately adopted in October 2008.
