completion date of the landscaping plan. Financial surety will be released <br />in accordance with City regulations. <br />C. Development Permits. The Developer shall apply for and obtain its first <br />development permit within one year of the City Council's approval of the Master <br />and Final Planned Unit Development Plan or such approvals shall expire unless <br />extended by the City Council prior to the PUD Development Plan's approval <br />expiration date. The extension request must be in writing to the City Planner at <br />least forty -five (45) days prior to the expiration date. As used herein the term <br />"Development Permit" includes, but is not limited to building permits, grading <br />permits and erosion control permits. <br />D. Use of Trails. Developer shall allow public use of the trail systems within the <br />development, so long as the public does not abuse the privilege or create an <br />adverse affect on the property. Developer's trail use policy will be applied to the <br />trail system shown on the site plan. Developer will notify the City thirty (30) <br />days in advance of a change to its trail use policy and the reasons for the change. <br />E. Construction Schedule Variations. City Planner shall be given written notice of <br />variations in the CS. City Council shall be advised of significant variations in the <br />CS and the reason for such variations. <br />F. As -Built Landscaping Plan. Upon completion of the project Developer shall <br />submit an as -built landscaping plan to the City. <br />G. Occupancy Permit. The City reserves the right to withhold occupancy permits if <br />demolition of existing buildings does not proceed according to CS unless the City <br />Council approves an extension of the building demolition date. <br />H. Compliance with City Regulations. During the redevelopment of the Property, <br />Developer shall comply with all applicable City Regulations, including but not <br />limited to, the Building Code, Fire Code, and the Zoning Code. If there is a <br />conflict between the City's Zoning Regulations and the provisions of this <br />Agreement, the provisions of this Agreement shall apply. <br />I. Container Screening. Garbage and recycling containers shall be fully screened <br />from the view of residential properties and shall be located in the lower level of <br />the loading and service area designated on the rendered site plan presented in the <br />November 3, 2010 Planning Case Report. <br />J. Stop Sign. If a warrant analysis indicates that a four -way or a three -way stop is <br />necessary at the intersection of the entrance to the Property on County Road D <br />and Wheeler Avenue, Developer, at its sole expense, shall construct such four <br />way or three -way stop according to plans and specifications approved by the City <br />Engineers for the City of Roseville and the City of Arden Hills. <br />6 <br />
