EN HILLS <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO.2025-069 <br />RESOLUTION APPROVING A VARIANCE <br />AT 3254 HAMLINE AVENUE NORTH <br />WHEREAS, City Staff received a complete land use application for a variance to the rear <br />yard setback for a deck from the City Code for the property located at 3254 Hamline Avenue North <br />and legally described on Exhibit A attached hereto ("Subject Property"); and <br />WHEREAS, the Applicant is proposing to construct a new deck and is seeking flexibility <br />with the required rear yard setback for a deck on the Subject Property; and <br />WHEREAS, the Subject Property is zoned R-1, Single Family Residential District, which <br />requires a minimum rear yard setback for a deck of 24 feet. The Applicant is proposing a rear yard <br />setback of 8.8 feet; and <br />WHEREAS, the Subject Property is nonconforming with the minimum rear yard setback <br />for a principal structure and has an existing rear yard setback of 8.8 feet; and <br />WHEREAS, a variance may be granted when it is in harmony with the general purposes <br />and intent of the zoning ordinance if enforcement of a provision in the ordinance would cause the <br />landowner practical difficulties; and <br />WHEREAS, pursuant to Minnesota State Statute, the City must act on this request by <br />October 25, 2025 (60 days), unless the City provides the petitioner with written reasons for an <br />additional 60-day review period; and <br />WHEREAS, the City provided the petitioner with written reasons for an additional 60-day <br />review period and extended the review period to December 24, 2025 (120 days) based on the date <br />of the submission for review by the Planning Commission and the City Council during the October <br />meeting cycle; and <br />WHEREAS, the City Council directed Staff to prepare a Land Use Application Public <br />Policy Notification to notify all property owners within 500 feet of Subject Property when a request <br />for the Planning Commission is to occur related to a land use application that does not require a <br />public hearing; and <br />Page 1 of 4 <br />
