<br />CITY OF CENTERVILLE <br />ANOKA COUNTY, MINNESOTA <br /> <br />ORDINANCE #______ <br />SECOND SERIES <br /> <br />AN ORDINANCE AMENDING CITY CODE , CHAPTER 156 <br /> <br />THE CITY COUNCIL OF THE CITY OF CENTERVILLE ORDAINS: <br /> <br /> Section 1. City Code Chapter 156, Section 156.030 is hereby amended by adding a <br />paragraph (N) which shall read as follows: <br /> <br /> (N) Interim uses in B-1 District. <br /> <br /> (1) Uses existing on a site in the I-1 Industrial District as a conforming use <br />prior to the site being rezoned from I-1 to B-1 may continue to be used <br />for such conforming I-1 uses, regardless of site ownership. In <br />addition, the activities and operations may be expanded on the site as <br />if the use was located in an I-1 District, until such time the use is <br />abandoned or changed to a use permitted in the B-1 District. After the <br />use of the site is abandoned or is changed to a permitted use in the B-1 <br />District, the site may not thereafter be used except as permitted in the <br />B-1 District. In the event of a proposal by the City to rezone the site <br />from I-1 to the B-1 District, the City Planning and Zoning Commission <br />shall, simultaneously with such rezoning action, determine whether the <br />site is a conforming industrial use qualifying for interim use status <br />under this section. In the event a determination is made that the use of <br />the site conforms to I-1 standards and this section, the City shall, <br />within sixty (60) days of such determination, file a notice of <br />compliance with the Anoka County Recorder. <br />Section 2: Effective Date: This ordinance shall be effective immediately upon its passage <br />and publication, according to law. <br /> <br />PASSED AND DULY ADOPTED this _____ day of ___________, 2011 by the City <br />Council of the City of Centerville. <br /> <br /> _______________________________ <br /> Tom Wilharber, Mayor <br /> <br />ATTEST: ______________________ <br /> Teresa Bender, City Clerk <br /> <br /> <br /> <br /> <br />
