CENTENNIAL FIRE DISTRICT <br /> JOINT POWERS AGREEMENT <br /> 33 Judicial Relief <br /> (a) Any municipality may seek judicial relief, to the extent authorized under <br /> Minnesota Statute Section 572.08 through 572.30 as the same may be <br /> amended, and, in addition under the following circumstances: <br /> -any municipality fails to select an arbitrator; <br /> - designated time limits have been exceeded; <br /> -the arbitrator has not proceeded expeditiously; or <br /> (b) Costs of the suit to be awarded to the prevailing parties. The cost of <br /> arbitration shall be borne equally by the municipalities. Each party shall <br /> pay its own attorney's fees. <br /> Section N <br /> General Powers of the Committee <br /> 4.1 Powers. The committee shall have and is hereby given all powers, duties <br /> and functions enumerated in this agreement, and all such further powers <br /> necessary to carry out the intent and purpose of the District with respect to <br /> acquisition of property and operation of the District heretofore set fourth, <br /> including the following: <br /> (a) To employ and determine the terms of employment of fire protection, <br /> administrative and other personnel, accountants, consultants, engineers, <br /> legal counsel, and other qualified personnel, except as provided in this <br /> agreement. <br /> (b) To cause reports, plans, studies and recommendations to be prepared. <br /> (c) To recommend purchase of capital equipment, as here in after defined and <br /> land, to recommend construction of buildings to implement the purposes <br /> herein set forth. <br /> (d) To lease or purchase equipment other than capital equipment and supplies <br /> necessary for the proper operation, care, maintenance and preservation or <br /> District facilities and equipment, except as otherwise provided in this <br /> agreement. <br /> (e) To adopt District bylaws, rules and regulations for the operation, <br /> maintenance and use of the District fire protection services, equipment and <br /> facilities. <br /> (f) To enter into mutual aid agreements with other organizations with similar <br /> purposes. <br /> Page # 4 <br />
