UNFINISHED BUSINESS <br /> Eagle Pass Road Update <br /> Mr. Nyberg gave an update on Eagle Pass Roads construction and drainage. The engineer plans <br /> to address additional drainage concerns this fall. In addition, Mr. Nyberg said before the second <br /> lift is constructed, the road will be properly repaired. The Council questioned the engineer about <br /> procedures and the time line to correct Eagle Pass Roads, The Council discussed testing methods <br /> and new testing developments. <br /> Eagle Pass Trail <br /> Mr. March reported the Eagle Pass Developers requested the Council consider exchanging a <br /> portion of the Eagle Pass trail for a cash settlement of $9,000. Mr. Nyberg said, currently, an 8' <br /> bituminous trail is proposed north of Dupre Road and south of Eagle Trail. However, the <br /> Developers have received considerable opposition to constructing the trail near the Dupre Road <br /> homes. In addition, the trail area is within the jurisdiction of an association. Therefore, the <br /> association will be responsible for maintaining the trail. Several new property owners requested <br /> the trail not be constructed. <br /> Councilmember Helmbrecht planned to look at the trail area that is in question. Councilmember <br /> Brenner asked that the Park and Recreation Committee review the proposal at its next meeting. <br /> Mayor Wilharber addressed several items for consideration in regards to constructing the trail. <br /> Foremost, the pond can be an attraction to children and the community might have potential <br /> liability concerns. And, does the City comprehensive park plan include this section of the trail. <br /> Mr. March addressed another issue with the Elementary watermain construction and its <br /> assessments. Evidently, the watermain assessment notices for the tree farm (Eagle Pass <br /> Development Area) was sent to an inactive property identification number. Therefore, the Eagle <br /> Pass Developers did not receive nor pay the $58,000 assessment. However, Mr. Quigley (Eagle <br /> Pass Developer) is willing to pay the assessed amount but he requested the city to waive the <br /> interest. Mr. March noted another option is to assess the outstanding balance to Eagle Pass <br /> (Phase II) outlot A. <br /> Councilmember Brenner moved and it was seconded to refer the Eagle Pass Trail to Parks and <br /> Recreation for a recommendation at the next Council meeting.
