Subdivision 5. Ordering Improvements and Advertising <br /> : p for Bids At any time within six months following the hearing r <br /> described in Subdivision 4 above, the Council may by resolution <br /> order the improvements. If the improvements were initiated by <br /> petition, a majority vote is needed. In the absence of a peti- <br /> tion, a four- fifths vote is required to order the improvements. <br /> When the proposed improvement is ordered by the Council, <br /> the Council may, by resolution, at any time within one year follow- <br /> ing the ordering of the improvement, proceed on the improvement by <br /> advertising for bids and letting an appropriate contract in <br /> accordance with Minn. Stat. §429.041. <br /> 3. Section 3. Apportionment of Cost The cost of improve- <br /> ments may be assessed where appropriate upon property benefitted <br /> by the improvement, based on the benefits received, whether or not <br /> _ the property abutts v:_ the improvement and whether or not any part <br /> of the cost of the improvement is paid from the County, StateAid <br /> Highwav Fund, the Municipal State -Aid Street Fund, or the Trunk <br /> Highway Fund in accordance with the rules described in Sections 5 <br /> through 12 of this Ordinance. <br /> 4. Section 4. Assessment Procedure In addition to the <br /> provisions of this Ordinance, assessments shall be made in <br /> compliance with the assessment procedures desc'ribed in Minn. <br /> Stat. §429.061 relating to the notice and conduct of assessment <br /> hearings, the adoption of proposed assessments, the transmission <br /> of certified assessment rolls to the County Auditor and other <br /> related matters. <br /> 3 <br />
