Permit. <br /> Mayor Wilharber referred to the Planning and Zoning meeting minutes dated March 12, 1998, <br /> which supported approval of the special use permit request and construction a wood frame <br /> building on the stated property. <br /> Councilmember Helmbrecht moved and it was seconded to allow Ken Strantz to ursue a wood <br /> frame building_ Motion carried unanimously_ <br /> The Schlavin Family Chiropractic Business <br /> Mr. March briefed the Council on the Schlavin variance request. Mr. Hellings noted he reviewed <br /> the variance request and he felt it is in the best interest of the City to be conservative when <br /> making a recommendation to Staff. Therefore, the legal council recommended Schlavin's attain a <br /> variance for the reconfiguration of their garage area. Furthermore, Mr. Hellings indicated no <br /> variance is required since the request was made from a "homeowner" not a "home based business <br /> owner." In addition, the ordinance verbiage allows a homeowner to convert a garage into <br /> another use. In conclusion, the legal council recommended to refund the applicant variance fees <br /> paid. Mr. Hellings noted legal fees associated with this variance issue will be returned since the <br /> error occurred because he was being too conservative. <br /> Councilmember Buckbee moved and it was seconded to deny the variance =uest and refund the <br /> money.
