Mr. March noted the City has to act upon the <br /> request within 60 days of the petition. Currently, the city has 10 days until the time limit expires. <br /> However, the March waiver form would allow the petitioner to table the issue until a later date. <br /> And, if the request is denied, the petitioner will have to reapply and go through the process again. <br /> Mayor Wilharber expressed concern the residents would not be informed if the issues are <br /> addressed at a later date. <br /> Councilmember Helmbrecht moved and it was seconded to deny the rezone request and the <br /> petition to vacate Clearwater Road with the condition that the denial is vacated if the petitioner <br /> signs a letter dated March 25 1998. and property owners within 350' be notified of future <br /> consideration of the issue Motion carried unanimously. <br /> Amendment to Ordinance 44 -A <br /> Mr. March recommended removing the commercial districts from the proposed amendment. <br /> 3 <br />
