Sidewalk on Revoir Street - Dennis and Molly Nelson (1860 Revoir St.l <br /> Mr. Nelson reported a developer planned a sidewalk for Revoir Street without the residents <br /> knowledge. Also, Mrs. Nelson concluded a petition was distributed among the Revoir residents <br /> and results shoed a majority were not in favor of a sidewalk. <br /> Councilmember Buckbee explained the property seller is required to disclose an easement exhibit <br /> indicating buyers knowledge. Such a violation may cause the Developer to be in violation of the <br /> development agreement. <br /> Ms. Nelson requested the City enter into negotiation with the Developer to put in a sidewalk in a <br /> higher traffic area. Councilmember Helmbrecht stated she was in favor of a sidewalk on Revoir <br /> Street. Councilmember Brenner agrees, but was concerned why the residents were not informed <br /> of the sidewalk. Councilmember Buckbee suggested the developer produce a signed exhibit from <br /> the property owners on Revoir Street. <br /> Ms. Nelson requested the Council's support for Revoir Street residents, and suggested the <br /> Developer reimburse the property owners for the land and materials due to the installation of a <br /> sidewalk. Councilmember Helmbrecht requested Staff check with the attorney on the legalities of <br /> this issue. <br /> Mr. Hatem Ouaheim - Complaint <br /> Mr. Hatem Quaheim (7251 Clearwater Drive) reported approximately 75 trees were removed <br /> from the Lakeland Hills Development which exposed the his rear yard and house. In contrast, <br /> the Developer stated during the preliminary plat discussion he would save the trees in the <br /> development. <br /> 7:15 p.m. Councilmember Powers arrived. <br /> Councilmember Buckbee explained the Developer owns the property and has the decision what to <br /> do with the property, Councilmember Helmbrecht explained the Developer may replace the trees. <br /> Mr. Black questioned what Mr. Hatem was requesting, noting during the preliminary plat <br /> discussion Mr. Hatem drainage concerns were addressed. Further, Mr. Black stated the <br /> development has accommodated Mr. Hatem's drainage concerns, and despite Mr. Hatem is now <br /> suggesting the drainage is not a concern. Concluding, Mr. Black suggested Mr, Hatem plant a <br /> bush to buffer the change. <br /> Councilmember Brenner noted herself and Councilmember Powers picked up tree preservation <br /> information at the League of Minnesota Cities Conference and suggested the City address this <br /> issue in the future. <br /> APPEARANCE: <br /> 3 <br />
