a <br /> or business of a; pawnbroker, precious metal dealer or Class A or Class B secondhand goods <br /> dealer within the City unless such person is currently licensed as provided in this chapter. A <br /> license shall be issued by the City Council for one year beginning on the date of the license. A <br /> single license may be issued to a corporation, limited liability company or partnership covering all <br /> of its employees or agents; provided, however, that the information required by Section 306.06 is <br /> provided for an individual.who will act as a pawnbroker or secondhand goods dealer. The City <br /> shall issue one license and the license shall be reviewed annually. <br /> 306.03 Exemptions Pawnbrokers and secondhand goods dealers shall not apply to or <br /> include the following: <br /> Subd. 1. The sale of secondhand goods where all of the following are present: <br /> a. The sale is held on property occupied as a dwelling by the seller, <br /> or owned, rented, or leased by a charitable or political <br /> organization. <br /> b. That no sale exceeds a period of 72 consecutive hours. <br /> c. The items offered for sale are owned by the occupant. <br /> d. No more than four (4) sales are held in any twelve (12) month <br /> period. <br /> e. None of the items offered for sale have been purchased for resale <br /> or received on consignment for purpose of resale. <br /> Subd. 2. The sale of secondhand books, or magazines, sport trading cards, sound <br /> or video recordings, or films. <br /> Subd. 3. The sale of goods at an auction held by a licensed auctioneer. <br /> Subd. 4. Sales by a person licensed as a motor vehicle dealer. <br /> Subd. 5. A bulk sale of property from a merchant, manufacturer or wholesaler <br /> having an established place of business or of goods sold at open sale from bankrupt <br /> stock. <br /> Subd. 6. Goods at a public or farmer's market. <br /> Subd. 7. Goods sold at an exhibition, providing the exhibition does not last longer <br /> than ten (10) days in any twelve (12) month period. <br /> 2 <br />
