MOTION by Councilmember Powers to close the public hearing. Motion seconded by <br /> Councilmember Brenner. Motion carried unanimously. <br /> Trio Inn <br /> Mayor Wilharber opened the public hearing for questions or comments. The Council discussed an <br /> alleged liquor law violation against the Trio Inn for selling alcohol on Thanksgiving Day. <br /> Mr. Hellings noted the Council can discipline now or scheduled a continuation hearing after the <br /> court proceedings. <br /> Mr. Paul Montain owner of Trio Inn Bar (7082 Centerville Road) explained his position. Mr. <br /> Montain agreed the off -sale violation was true. However, the action was not intentional and <br /> there was no effort to deceive the City. Mayor Wilharber questioned Mr. Montain if the bar has a <br /> policy or procedures for selling off -sale. Mr. Montain said the responsibility is with the managers <br /> to direct bar tenders to either sell or not to sell and it was a management oversight. <br /> MOTION by Councilmember Powers to close the public hearing. Motion carried unanimously. <br /> APPEARANCES <br /> CPLPD Recommendations for Waterworks Beach Club - Richard DeFoe <br /> Chief VanBurkleo summarized the meeting between Mr. DeFoe and himself. Chief VanBurkleo <br /> reported he had a productive meeting with Mr. DeFoe and all issues on the memorandum were <br /> addressed to his satisfaction. Councilmember Powers stressed a safety concern with the <br /> additional eighteen plus night, which makes three eighteen plus nights. Chief VanBurkleo stated <br /> the Police Department plans to address Mr. DeFoe's commitment to providing adequate security. <br /> However, the Chief was unaware of an additional eighteen plus night. <br /> Mayor Wilharber read aloud the Circle Pines - Lexington Police Department ( CPLPD) <br /> recommendations for Waterworks Beach Club. Mr. Bill Bisek (7098 Centerville Road) stressed <br /> the State laws' spell out the Police Department's recommendations, such as, a bar cannot sell <br /> alcohol to an obviously intoxicated person. Furthermore, placing contingencies on a liquor <br /> license is unnecessary. Mr. Bisek added, this may eventually become a Council habit to put <br /> stipulations on all liquor licenses. Mr. Hellings noted it is within the City's authority to place <br /> stipulations on any liquor establishment. <br /> Mayor Wilharber commented the recommendations were out of fairness to the liquor <br /> establishment. As a friendly reminder these are the State laws and the City will be looking closely <br /> at the stated areas. Mayor Wilharber asked Mr. DeFoe, "How many eighteen plus nights are held <br /> at Waterworks ?" Mr. DeFoe responded the Staff completed training, therefore, he resumed the <br /> eighteen plus nights which totals three nights. <br /> Councilmember Powers stressed her concern about the eighteen plus nights.
