CITY OF CENTERVILLE ANOKA COUNTY STATE OF MINNESOTA RESOLUTION 97 -26 A RESOLUTION REQUESTING AUTHORIZATION FROM THE ANOKA COUNTY BOARD OF COMMISSIONERS FOR SNOWMOBILE USE ON THE NORTH AND SOUTH SHOULDER OF COUNTY STATE AID HIGHWAY 14 (MAIN STREET) FROM MILL ROAD TO COUNTY STATE AID HIGHWAY 21 (20TH AVENUE) IN THE CITY OF CENTERVILLE. WHEREAS, on November 12, 1997 the City Council of the City of Centerville moved to request authorization from the Anoka County Board of Commissioners to allow snowmobile use on the north and south shoulder of County State Aid Highway 14 (Main Street) from Mill Road to County State Aid Highway 21 (20th Avenue), because the safe operation of snowmobiles in the remaining portion of right -of -way adjacent to County State Aid Highway 14 is not possible; and, WHEREAS, the safe operation of both vehicles and snowmobiles on this section of County State Aid Highway 14 in this area is possible: WHEREAS, Minn. Slat. 84.87, subd, I provides in part, "No person shall operate a snowmobile upon the roadway, shoulder, or inside bank or slope of any Trunk, County State Aid, or County Highway in this state and, in the case of a divided Trunk or County Highway, on the right -of -way between the opposing lanes of traffic ... ," and, WHEREAS, Notwithstanding the provisions of Minn. Slat. 84.87, subd. IA, a county may, pursuant to Minn. Slat. 84.87, subd. 3, by resolution, allow for snowmobile traffic on the shoulder of a County State Aid Highway if the county finds that safe operations in the ditch or outside bank or slope thereof is not possible; and, WHEREAS, Minn. Slat. 84.87, subd. IA, provides, "Nothing in this section or chapter 169 shall prohibit the use of snowmobiles within the right -of -way of any state trunk or county state -aid highway or upon public lands or waters under the jurisdiction of the commissioner of natural resources, in any organized contest, subject to the consent of the official or board having jurisdiction over the highway or public lands or water. In permitting such contests, the official or board having jurisdiction may prescribe such restrictions or conditions as they may deem advisable," and, WHEREAS, Minn. Slat. 84.804, subd. 1, b, states, "A person may not operate a vehicle off -road within a public road right -of -way between the hours of one -half hour after sunset to one -half hour before sunrise, except on the right -hand side of the right -of -way and in the same direction as traffic on the nearest lane of the road." and.
