ULhAKW A 1 hK MhAD V W <br /> MOTION by Zoff- Pelton, second by Bisek to take $750 per lot at 31 lots for park land <br /> dedication. Motion carried unanimously. <br /> MOTION by Zoff - Pelton, second by Bisek to waive the $150 per lot for trail dedication, <br /> to enforce the sidewalk ordinance requiring sidewalks on Brian Drive, and to include <br /> recorded trail easements (20 feet wide) between lots 3 & 4, 13 & 12, and 23 & 24 for <br /> future development. Motion carried unanimously. <br /> P &R would Eke the City Council to have the engineer design utilities so they allow for <br /> future trail development. In addition, per the MSA letter of January 5, 1996, per <br /> paragraph 6, this conservation land is not park land and will be privately owned. <br /> Maintenance would be as with other ponds and ditches. <br /> CITY COUNCIL — JANUARY 24,1996 <br /> As per Dave Nyberg's letter dated January 23, 1996 he recommends at this time to order <br /> preparation of a feasibility study on the proposed improvements. It also states that the <br /> feasibility study will include such issues as permits, floodplain regulations, potential utility <br /> alignments, and proposed street cross - sections. If the Council so desires, the feasibility <br /> study will also include a review of possible water hook -ups for the residents on the east <br /> side of Brian Drive. <br /> MOTION by Buckbee, second by Helmbrecht of the acknowledgment of receipt of the <br /> petition for local improvement for project referred to as Clearwater Meadows. Motion <br /> carried unanimously. <br /> Buckbee stated that the Resolution should state adequacy of petition. <br /> MOTION by Buckbee, second by Helmbrecht to approve resolution 96 -07 a resolution <br /> declaring adequacy of the petition and ordering preparation of a study for improvement. <br /> Motion carried unanimously. <br /> PLANNING & ZONING — FEBRUARY 6, 1996 <br /> PUBLIC HEARING - CLEARWATER MEADOWS REZONING <br /> Rockey Goertz explained that the area of the project that needs to be rezoned consists of <br /> the area south of Brian Drive, which is in the MUSA, currently zoned R -3 and on the east <br /> side of the project approximately an 85 foot strip of commercial property to residential. <br /> Kathy and Mike Johnson, 7046 Brian Drive expressed some concerns regarding lot 21, of <br /> block 2, because the front of their house would face the side of the new house. <br /> The commission and Mr. Goertz went over the MSA letter dated February 6, 1996 <br /> regarding the preliminary plat and grading plan review. <br /> CLRMM.WPS 3 <br />
