Council Meeting November 13, 1996 <br /> City of Centerville - MOTION by Brenner, seconded by Buckbee to approve the <br /> disbursements and receipts from October 24 through November 1 st. Motion carried <br /> unanimously. <br /> City of Centerville - MOTION by Buckbee, seconded by Brenner to approve the <br /> November 1 through 13th receipts and disbursements. Motion carried unanimously. <br /> SET AGENDA <br /> New Business: Drainage issue <br /> Planning and Zoning appointing a new member <br /> Two items under administrators report <br /> MOTION by Buckbee, seconded by Helmbrecht to approve the set agenda. <br /> Motion carried unanimously. <br /> PETITIONS AND COMPLAINTS <br /> APPEARANCES <br /> UNFINISHED BUSINESS <br /> Clearwater Meadows - Nyberg explained the Clearwater Meadows developer had <br /> objected to the assessments, feeling there should be a deduction in the assessment amount <br /> for a shared cost on the watermain behind City Hall for Eagle Pass and Clearwater <br /> Meadows and a shared cost for credit used for the watermain on Brian Drive. <br /> Buckbee requested the developer drop any threat of litigation if the council approves the <br /> decrease in the assessments. Wilharber suggested the intent be included in the minutes <br /> and requested the developer state such for the record. <br /> Rockney Goertz, Developer stated "We agree to the assessment amount being reduced <br /> $13,310.72 per lot, and we understand there won't be any refunds on the watermain or the <br /> Brian Drive services, they would be incorporated into the lower assessments and we agree <br /> with the 5 year terms ". Yoch included, in the future there may be a reassessment. <br /> Further, "as Rockney's Attorney, we will not pursue the city in litigation regarding this <br /> situation with Clearwater Meadows, we will be dropping/waMng the issues ". <br /> Hellings stated he is comfortable with the resolution. <br /> MOTION by Helmbrecht, seconded by Brenner to close the public hearing. Motion <br /> carried unanimously. <br /> MOTION by Buckbee, seconded by Helmbrecht to adopt the assessment role for <br /> Clearwater Meadows in the amount of $13,310.72 and Brian Drive water services at <br /> 4 <br />
