<br />Mr. Kellier indicated that state statute pertains to workmanship and material of one year, <br />two years on plumbing and heating and 10 years on structural so they are not sure of the <br />timeframes of Council. He then said that they typically put up the letter of credit and <br />there is uSually a year or so that the utilities are in the ground before you even get into <br />construction. He further commented the second lift of blacktop would not be added until <br />the second phase is completed so they are not sure when the two years begins. <br /> <br />City Attorney Hoeft indicated the agreement indicates the period begins following the <br />City's final acceptance of final improvements. He then said that the way the City has <br />dealt with this issue in the past has been through subparagraph f and allowing a reduction _ <br />in escrow as things are completed. <br /> <br />City Engineer Peterson indicated that if they could get the utilities in this year and have <br />them televised the City can approve them and then the time period would be <br />approximately as mentioned. <br /> <br />Mr. Kellier indicated he would be fine with that proposal. <br /> <br />City Attorney Hoeft indicated he would prefer to clean the document up and make sure <br />there are no other issues to be addressed and present it at the next meeting for approval. <br /> <br />Motion bv Council Member Broussard Vickers. seconded by Council Member ._ <br />Capra to table the Jackson CommerciaL L.L.C. and Final Plat to the next meetine:. <br />All in favor. Motion carried unanimouslv. <br /> <br />Council Member Paar indicated he received some calls on the City using TIF and was <br />asked to determine what types of projects the City has done using TIF and whether they <br />were a benefit to the City or not. <br /> <br />Mr. Pat Pelstring indicated that the information provided used a 25 year district but that <br />would be up to Council. <br /> <br />Council Member Capra indicated she does not think the City has ever done a district for <br />25 years. <br /> <br />Ms. Moore-Sykes indicated the length of time would be up to the City. <br /> <br />Council Member Capra indicated she would like to know what the City has done in the <br />past and what the benefits have been. <br /> <br />City Attorney Hoeft indicated that the benefit to the City is that usually the project would <br />not have happened but for the TIF so the City would have additional tax dollars off that <br />project. He then indicated that the City would not recoup that increment in the taxes until <br />that district expires. <br /> <br />Page 6 of 14 <br />
