<br />City Attorney Hoeft indicated the developer had asked that the private improvement <br />section be amended to indicate that the construction would be done in phases and he <br />suggests 8:. separate developers agreement for each phase. <br /> <br />City Attorney Hoeft indicated the developer had asked for language to allow a certificate <br />of occupancy prior to bituminous being installed and he has no issue with that provided <br />that all ADA regulations are complied with as requested by the Public W orksOfficial. <br /> <br />Council Member Broussard Vickers suggested the City could build in an escrow to cover <br />the paving to ensure that it is completed. <br /> <br />City Attorney Hoeft questioned whether there would be a ceriter monument. <br /> <br />Council indicated that there would be one and the association would be responsible for <br />maintaining it. <br /> <br />City Attorney Hoeft indicated that the developer has requested a one-year guarantee on <br />workmanship and materials and the City has required two years and he would not <br />recommend changing that. <br /> <br />Council Member Lee indicated the state contractor's licensing standard is two years. <br /> <br />City Engineer Peterson indicated his issues were listed in the memo. <br /> <br />Mr. . Paul Kellier indicated that he and Mr. Montgomery are the principals of Sedona <br />Homes and Jackson Commercial, L.L.C. and then provided a copy of the articles of <br />incorporation to the City Attorney. He then indicated that he would provide a copy of the <br />purchase agreement to the City Attorney for review. <br /> <br />Mr. l<ellier indicated that they did not have an issue with having two separate developer's <br />agreements, one for each phase. <br /> <br />Mr. Kellier indicated that the reason for the request for allowing a certificate of <br />occupancy before bituminous is in case of winter conditions not allowing for paving. He <br />then indicated that they would meet all ADA standards. <br /> <br />Council discussed the paving issue and determined they would like to require an escrow <br />if the developer requests the certificate of occupancy prior to the paving being completed. <br /> <br />Mayor Sweeney asked where the development on the site would begin. <br /> <br />Mr. Kellier indicated they are starting on the side closest to the construction of the water <br />tower but said they are willing to work out the timing to allow space for the construction <br />of the water tower.
