<br />City of Centerville <br />August 13, 2003 <br />Council Meeting Minutes <br />City Attorney Hoeft indicated he does not see a liability issue for the City because the <br />City will just add that piece onto its insurance. He then said it is not the City's <br />responsibility to help someone if they misinterpret something they are purchasing. <br /> <br />Council Member Paar indicated he had not changed his mind from pressure of residents <br />contacting him but because he now has all the facts concerning previous Council <br />discussions and promises and he feels it is right to provide this park to the residents <br />because it was promised to them. <br /> <br />Council Member Lee commented that the Park and Recreation Committee did not <br />appreciate being left out of the loop with regard to this park issue. <br /> <br />Motion was made bv Council Member Paar and seconded bv Council Member <br />Capra to reconsider. Aves - 3. Navs -l(Sweenev). Motion carried. <br /> <br />Motion was made bv Council Member Capra and seconded bv Council Member <br />Paar to re-desimate the westerlv 50 feet of the drainaee and utility easement <br />currentlv on Lot 1. Block 1 of Peltier Preserve as a drainaee. utility and park <br />easement. Aves - 3. Navs -l(Sweenev). Motion carried. <br /> <br />Motion was made bv Council Member Capra and seconded bv Council Member Lee <br />to approve the developer's aereement for Peltier Preserve. All in favor. Motion <br />carried unanimouslv. <br /> <br />3. Hunter's Crossing 2nd Addition Developers Agreement & Final Plat <br /> <br />Mr. Rick Carlson asked that Council review with him a few aspects of the developer's <br />agreement. He then asked that the escrow be further defined as monies that he would be <br />reimbursed for and not monies that are applied to indirect costs. City Attorney Hoeft <br />indicated that the word escrow means that they are monies that are ultimately reimbursed. <br /> <br />Mr. Carlson asked that Council make accommodation for allowing model homes prior to <br />the utilities being completed and indicated that he has four lots that would meet the 150 <br />foot requirements. City Attorney Hoeft indicated his only concern would be that the <br />developer agrees to have the City's engineer check the grade at that lot before the model <br />home is constructed because final grade is not completed at that time. <br /> <br />Mr. Carlson indicated he had no problem with that. <br /> <br />Mr. Carlson indicated that he had included a center island with landscaping and would <br />like to leave that out as he believes it is a maintenance problem. <br /> <br />Council discussed it and agreed to leave the island out because it hampers snow removal <br />and maintaining it becomes an issue. <br /> <br />Page 8 of 13 <br />
