<br />City of Centerville <br />August 13, 2003 <br />Council Meeting Minutes <br /> <br />Mr. Schoeberlein indicated that he has not done anything yet because he needs to do <br />research into what is appropriate because it is a major investment. He then indicated that, <br />when his house was built, drain tile and sump pumps were not required and doing so after <br />the fact is costly. <br /> <br />Council Member Capra asked what the recommendation from Planning and Zoning was <br />for this matter. Ms. Moore-Sykes indicated that the Planning Commission recommended <br />approval of the MUSA advancement and asked that Council look into the water issues <br />with Mr. Schoeberlein and review the overall drainage plan for the development before <br />the commencement of construction on Phase ill. <br /> <br />Mr. Palzer indicated that in 1996 or 1997 the City was going to do some ditching in the <br />area because of an ongoing drainage problem in the area but the City does not have <br />easements there and when the City attempted to get them, the City met with resistance <br />from the neighbors. He then said that with the development of Pheasant Marsh water <br />from 8 to 10 acres has been rerouted and no longer goes through his backyard as it had. <br />He then said that the ditch was cleaned out and if that was continued that would help but <br />there is no easement in the area <br /> <br />Council Member Capra asked if the City has the right to have water running off onto that <br />property if there is no drainage easement. <br /> <br />City Attorney Hoeft indicated that the City is only going to use easements for drainage <br />and utilities. He then said that if the property owner wants to grant an easement, the City <br />can look at doing the work or the City could look at the benefit of condemning the <br />property for an easement. <br /> <br />Mayor Sweeney asked for a map from Public Works of the area to review and discuss at <br />the work session. <br /> <br />Mr. Palzer indicated that there was fabric over the drain so the drainage change was not <br />effective until sometime this summer. Mr. Peterson indicated that most of the water <br />comes from the backyards and there are no easements in that area. <br /> <br />Mr. Palzer indicated that the City has a few options, but commented that Center Street <br />drains a lot of water through the backyards and when--the street is reconstructed the-(;ity <br />could look at rerouting water to the north so that it does not drain into the backyards. <br /> <br />Council Member Lee asked if there is standing water now. Mr. Schoeberlein indicated <br />there is not but said it has been very dry. <br /> <br />Mr. Schoeberlein indicated that if the work done after the pictures were taken solves the <br />water problem he would be happy, but if after a rain storm he still has water, he will be <br />back. <br /> <br />Page 3 of 13 <br />
