Hunter's Crossing 2nd Addition - Feasibility Study Resolution #03-042 <br /> <br />Council Member Capra asked if there is over sizing on this project and Mr. Peterson <br />indicated that there is. <br /> <br />Mr. Peterson indicated that he has counted Outlot B as a possible assessment and 6882 <br />was never assessed for sewer or water and Mr. Wilharber has an agreement with the <br />developer to bring him services. <br /> <br />Motion bv Council Member Lee. seconded bv Council Member Paar to approve <br />Resolution #03-042 as presented. All in favor. Motion carried unanimouslv. <br /> <br />4. Peltier Preserve Final Plat/Developer's Agreement <br /> <br />Council Member Broussard Vickers indicated there is a portion about charging the <br />developer any and all fees associated with development and under that section there is <br />wording concerning interest costs. She then asked if that would allow the City to collect <br />on a prepayment situation on the bond. <br /> <br />City Attorney Hoeft indicated that he had not drafted the document with that in mind <br />because this agreement was drafted before that item was discussed. He then said that <br />language would have to be developed to build that into this developer's agreement. He <br />then explained that as in the case of the right to object to assessments the fact that the <br />City is taking away the right to prepay would need to be specifically outlined in the <br />document along with the prepayment penalty. <br /> <br />City Attorney Hoeft recommended that the City contact Mr. Eilertson to obtain a <br />calculation chart listing lost interest month by month to assist him with determining what <br />a prepayment penalty would be. <br /> <br />Page 14 of24 <br />
