<br />". <br /> <br /> <br />TO: <br /> <br />Honorable Mayor and Council Members <br />Teresa Bender, City ClerkJ(~' <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />1695 Sorel Street - Mr. Tlm Hoeft Discussion <br /> <br />DATE: <br /> <br />July 3,2003 <br /> <br />Upon Mr. Kilian's submission of plans to construct a 968 square-foot garage and <br />reviewing his address file in regards to a previous submission for a variance request, I <br />contacted Mr. Hoeft in regards to the 60-day rule and lack of action by Planning and <br />Zoning to either gfant or deny Mr. Kilian's request. <br /> <br />Upon discussing this issue with Mr. Hoeft we noted the following: the original variance <br />request application had not been signed or dated, the ordinance that governs accessory <br />structure requirements (Ordinance #4) had been amended on September of 2000, the <br />zoning district for Mr. Kilian's property had changed as a part of this amendment, and <br />Mr. Kilian too no action prior to the amendments. Therefore, Mr. Kilian's original <br />variance request application is void. <br /> <br />Further research has shown that the Planning and Zoning Commission tabled Mr. <br />Kilian's variance request on May 4, 1999. The June Planning and Zoning Commission <br />did not address this issue; however, it appears that there was some tum-over in members <br />and amendment consideration of Ordinance #4 at that time.
