<br />City of CentCrville <br />June 25, 2003 <br />Council Meeting Minutes <br /> <br />Ms. Moore-Sykes indicated this matter had been placed on the agenda by request of Mr. <br />Gaugne but the City has not received the necessary documents from him. <br /> <br />Council Member Lee asked whether the City has received the required fees. Ms. <br />Paulseth indicated that the fees have not been received. <br /> <br />Council agreed that nothing moves forward until the required fees are paid. <br /> <br />City Attorney Hoeft indicated that the grading is not the critical point and said that he <br />would think that the City would want him to finalize that and then prevent him from <br />moving beyond that until the fees are paid. <br /> <br />2. Proposed Additional Language for Developer Agreements (Construction Noise) <br /> <br />Council Member Broussard Vickers indicated that Council had discussed at a work <br />session the likelihood of problems with developers prepaying on bond situations as the <br />City is facing fairly significant shortfalls coming up. She then asked if the City could <br />require the developers by development agreement to pay their fees for the prescribed <br />length of the bond period and not allow early payoff or if the City can assess the cost of <br />the interest on the bond to the developer so the City is not losing interest. <br /> <br />City Attorney Hoeft indicated the first answer would be not but the issue of repayment <br />and shortfalls can be worked in for payments with regard to the developers' agreements <br />still giving the developer the opportunity to payoff early if desired but requiring the <br />shortfall to be paid as well. <br /> <br />Council Member Broussard Vickers asked if that could be done with the ones in place <br />now. <br /> <br />City Attorney Hoeft indicated the argument could be made but he is not sure how it <br />would be interpreted by the court system. <br /> <br />Council Member Broussard Vickers indicated that she is concerned with the existing <br />agreements and she would like to see if the City could look into whether it is possible to <br />collect from the developers the shortfalls. <br /> <br />City Attorney Hoeft agreed to look into the matter and provide further information and <br />discussion at the next meeting. <br /> <br />2. Proposed Additional Language <br /> <br />Ms. Moore-Sykes indicated that Staff is seeking input from Council concerning whether <br />language should be added to the developers' agreements to limit construction noise on <br />weekends and holidays. <br /> <br />Page 6 of 12 <br />
