<br />any and all claims, of whatever nature, arising out of or relating to any act or omission of Buyer <br /> <br />or Buyer's agents on the Property. Buyer shall not permit any mechanic's liens to be filed <br /> <br /> <br />against the Property, and shall immediately discharge or obtain releases of any such mechanic's <br /> <br /> <br />liens. Buyer shall not be liable for any existing conditions on the Property, provided the Property <br /> <br /> <br />is restored to the condition as it exists on the date hereof. <br /> <br />11. REPRESENTATIONS AND WARRANTIES BY SELLERS. Sellers represent <br /> <br />and warrant to Buyer as follows: <br /> <br />a. Ownership. Sellers are the sole owners of, and have fee simple title to, the <br /> <br />Property. Prior to closing, Seller at his sole expense, shall provide a certificate of <br /> <br />survey and surveyor's legal description for the property to be acquired. <br /> <br />b. Authority. Sellers have the requisite power and authority to enter into and <br /> <br /> <br />perform its obligations under this Option. This Option shall be deemed a valid <br /> <br /> <br />and binding obligation of Sellers, enforceable according to its terms and <br /> <br /> <br />conditions. <br /> <br />c. Hazardous Substances. Sellers know of no hazardous substances or petroleum <br /> <br />products having been placed, stored, or released from or on the Property by any <br /> <br />person in violation of any law. To the best of Sellers' knowledge, there have been <br /> <br />no acts or occurrences upon the Property that have caused or could cause <br /> <br />hazardous substances or petroleum products to be released or discharged into the <br /> <br />subsoil or ground water of the Property or other property in the area. To the best <br /> <br />of Sellers' knowledge, the Property is free of hazardous substances and is not <br /> <br /> <br />subject to any "superfund" type liens or claims by governmental regulatory <br /> <br /> <br />agencies or third parties arising from the release or threatened release of <br /> <br /> <br />hazardous substances in, on, or about the property. <br /> <br />4 <br /> <br />11 <br />
