<br />d. Use and Zoning. Sellers' use of the Property complies with all applicable laws, <br /> <br /> <br />statutes, ordinances, rules and regulations, including, but not limited to, the <br /> <br /> <br />existing zoning laws for the Property. <br /> <br />e. Wells. Sellers certify that Sellers do not know of any wells on the Property, as <br /> <br /> <br />that term is defined under Minnesota Statutes Chapter 1031. <br /> <br /> <br />f. Storage Tanks. There are no "above ground storage tanks" or "underground <br /> <br /> <br />storage tanks," as those terms are defined by Minnesota Statutes Chapter 116, <br /> <br />located on, in or under the Property. Any above or below ground storage tanks <br /> <br />have been removed or filled in compliance with applicable law. <br /> <br />g. Individual Sewage Treatment System. There are no individual sewage treatment <br /> <br />systems, as that term is defined by Minnesota Statutes Chapter 115, located on the <br /> <br />Property . <br />h. Non-Foreign Sellers. Sellers are not foreign persons, trust, partnership or estate, <br /> <br />as those terms are defined under Section 1445 of the Internal Revenue Code, and <br /> <br />the regulations promulgated thereunder, and will execute a non-foreign sellers <br /> <br />affidavit at Closing. <br /> <br />1. Litigation. There is no pending litigation, arbitration or other legal proceedings <br /> <br />affecting or involving the Property. <br /> <br />Except as stated above, the Property is sold in its "as is" condition, without warranty express or <br /> <br />implied. Buyer acknowledges that, with the exception of the representations and warranties set <br /> <br />out herein, Buyer will rely on its own inspections and testing of the Property in purchasing the <br /> <br />Property . <br />12. SELLERS' COOPERATION. Sellers shall cooperate with Buyer and take such <br />reasonable actions as are needed for Buyer to obtain governmental approvals for Buyer's <br /> <br />5 <br /> <br />19 <br />
