<br />1.06 The City Council hereby directs that such a study be undertaken by the City's <br />planning and zoning commission. <br /> <br />1.07 There is a need for an interim ordinance for the purpose of protecting the planning <br />process and the health, safety and welfare of the citizens of the City. There is a need to restrict <br />such uses until the study has been completed and any modifications to the City's official controls <br />are accomplished. <br /> <br />1.08 Minnesota Statutes ~462.355, Subd. 4 (2003) pennit the adoption of an interim <br />ordinance during the planning process. <br /> <br />Section 2. <br /> <br />DEFINITIONS <br /> <br />The following terms whenever used in this Ordinance shall be interpreted to mean: <br /> <br />R-2: Property zoned R-2 (Single Family Residence District) in the City's Zoning <br />Ordinance. <br /> <br />M-l: Property zoned M-I (Mixed Use District) in the City's Zoning Ordinance. <br /> <br />Study Area: The area shown on the map attached as Exhibit A, consisting of <br />approximately 28 acres. <br /> <br />Official Controls: City plans and ordinances which control the physical development of <br />the City including the City's Comprehensive Plan, Zoning Ordinance, and Subdivision <br />Ordinance. <br /> <br />Plat: The drawing or map of a subdivision prepared for filing of record pursuant to <br />Minnesota Statutes Chapter 505 (2003) and containing all elements and requirements set <br />forth in applicable Centerville ordinances adopted pursuant to Minnesota Statutes Section <br />462.358 and Chapter 505 (2003). <br /> <br />Section 3. <br /> <br />TEMPORARY MORATORIUM <br /> <br />Pending the completion of the above referred to study and adoption of appropriate <br />official controls, no plat for land located in whole or in part in the Study Area, nor <br />building permit for an existing lot located in whole or in part in the Study Area, shall be <br />approved and no application for such approval will be accepted. This ordinance shall not <br />apply to the following: <br /> <br />a. Plats which have been preliminarily approved by the City Council <br />prior to the adoption of this Ordinance, unless that approval is void <br />pursuant to the Centerville City Ordinances; <br /> <br />b. Building permits which are for interior or exterior repair or <br />maintenance purposes, but not including enlargements of a <br /> <br />2 <br /> <br />31 <br />
