3) Rate Increases: Prices for Year one (2013) and Year two (2014) prices are set as above. Prices for Years 2015, 2016 and 2017 will increase on the anniversary date equal to the Consumer Price Index (CPI) — All Urban Users —MN, WI published monthly at http: / /www.bls.gov /cpi /home.htm but will not exceed a 3% increase. If the parties agree to extend the contract for two additional years, the first year of the extension (Year 6) shall be at the same rates as year five and for Year 7, the regular price increase shall be allowed(CPI not to exceed 3 %). 4) Fuel Surcharge The City agrees to pay Contractor an additional fee if diesel fuel increases to a dollar amount equal to or above $4.00 per gallon. If diesel fuel remains below $4.00 per gallon, the fuel surcharge will be 0 percent. If diesel fuel is at or above $4.00 per gallon, the following percentages will apply to Waste Management's base rate. The price published for the first Monday of the month will be used as that month's diesel fuel price.
