Phase II Industrial Activity Permits

Page 1 of3

Kim Moore-Sykes

From: Neprash, Randy D [rneprash@bonestroo.com]
Sent: Wednesday, May 21,200310:14 AM
To: Neprash, Randy D
Subject: Info from the MPCA - [phaseii] Phase" Industrial Activity Permits
Importance: High

-----Original Message-----
From: Frazell, Kevin [mailto:KFrazell@LMNC.ORG]
Sent: Wednesday, May 21,20039:58 AM
To: Phaseii
Subject: [phaseii] Phase II Industrial Activity Permits

~~f6 ti'-tel tLi io-o-h~
i/liro +k;.A.
K/~t6

Heather Worthington, City Administrator of Falcon Heights, has asked that we send
out the following information regarding MPCA Phase II Industrial Permit
applications. Information you might be able to use!

Thanks, Heather!

Dear Colleagues:

I wanted to apprize you of a situation that arose today regarding the NPDES Phase
II Permit, Industrial Activity.

Yesterday our mayor received a letter from the MPCA at her home informing her that
the city had missed a "deadline for submitting application for general storm water
permit for industrial activity." Like other cities, we had already submitted our
regular permit application on May 7th, but had been informed earlier in the year
that since we did not meet the criteria for "industrial activity", we would not be
required to submit an application for that permit.

I called the number listed in the letter, and spoke with an employee of the MPCA
who was very helpful in explaining the need to file for an exemption from the
permit. I asked him how many calls he had received, and he estimated that between
he and his co-workers, it totaled nearly 80 calls yesterday, and they were on track
to meet that number today. I then asked if there was a penalty for late submission
of the application, and he replied that since the MPCA had made the error in
notifying the MS-4 cities about the need to apply for an exemption, he did not
believe that there would be a penalty.

In short, I wanted to let you know that this letter was sent because of an error in
communication from the MPCA to the cities, not because of a city error in not
applying for the exemption. 1,800 cities received this letter, according to the
MPCA employee I spoke with.

Further, since the letter went directly to the homes of mayors, and not to the city
hall, you may not be aware of this yet.

5/21/2003
