CONSENT DECREE, <br /> SPECIAL ASSESSMENT AGREEMENT, <br /> WAIVER OF HEARING AND APPEAL <br /> CONSENT DECREE & AGREEMENT made this day of August, 2012, by and <br /> between the City of Centerville, a Minnesota municipal corporation ( "City "), and Patrica R. <br /> Camp -Baron and Michael A. Baron ( "Property Owner"). <br /> RECITALS <br /> A. Property Owner is the fee owner of the following described real property, located <br /> in the City of Centerville, Anoka County, Minnesota ( "Subject Property"), at 7121 Centerville <br /> Road, Centerville, Minnesota, legally described as, LOT 4 BLOCK 9 CENTERVILLE, TOG/W <br /> S1 /2 OF LOT 5 SD BLK 9, and, LOT 6 & THE N1 /2 OF LOT 5 BLK 9 CENTERVILLE. <br /> B. The Subject Property contains building materials and other debris, and structures <br /> which are in disrepair, all of which is unsightly and does not does not comply with applicable <br /> law or regulation. The City considers these conditions to create a nuisance. <br /> C. The i <br /> C and the Property Owner have p rty ve worked together for over a year attempting <br /> to allow the Property Owner to remediate the nuisances found on the Subject Property. City Staff <br /> met with the Property Owner on 7/5/11, 8/3/11, 8/31/11, 9/14/11, 10/5/11, 10/19/11, 11 /16 /11, <br /> 5/21/12, and 6/11/12. During these meetings, the Property Owner promised to work towards <br /> remediation of the problems on the Subject Property. Over this period, the Property Owner was <br /> not able to remediate the problems on the Subject Property. <br /> D. On June 27, 2012, Pat Camp -Baron appeared before the Centerville City Council. <br /> With her agreement, the Council passed a Resolution authorizing City Staff and the City <br /> Attorney to engage the Property Owner in litigation to remediate the nuisance found at the <br /> Subject Property. The cost of this litigation and remediation would be assessed to the Subject <br /> Property. At Ms. Camp - Baron's request, the City stayed action on its Resolution until July 18, <br /> 2012 in order to allow the Property Owner to remediate the nuisances found on the Subject <br /> Property. <br /> -1- <br />
