E. On July 20, 2012, the nuisances on the Subject Property were not remediated. The <br /> City began litigation. <br /> F. Now, the Property Owner seeks additional time to remediate the nuisances found <br /> on the Subject Property. They also ask the City to stay litigation in order to avoid incurring <br /> litigation expenses which would ultimately be assessed to the Subject Property. In exchange, <br /> they ask the City to enter into this Consent Decree and the other Agreements found in this <br /> document. <br /> CONSENT DECREE <br /> NOW, THEREFORE, IN CONSIDERATION OF THEIR MUTUAL <br /> COVENANTS, THE PARTIES HERETO AGREE AS FOLLOWS: <br /> G. Property Owner shall remediate all the nuisances found on the Subject Property <br /> on or before September 1, 2012. <br /> H. The City Building Inspector will inspect and judge whether nuisance conditions <br /> on the Subject Property comply with City Ordinances, the State Building Code, or any other <br /> applicable law or regulation. It shall be his decision, and his decision alone, which shall govern <br /> the decision as to whether conditions on the Subject Property comply with applicable law or <br /> regulation. <br /> I. If the Building Inspector determines that the conditions on the Subject Property <br /> do not comply with applicable law and regulation by the deadline stated above, the Property <br /> Owner grants the City permission, in the form of a license, to enter the Subject Property and <br /> remediate the nuisances conditions found on the Property. This license shall last for a period of <br /> sixty -days beginning the day after the deadline stated above. This license authorizes the City to: <br /> i. remove any plants, trees, or vegetation which are noxious or specifically illegal, <br /> or remove debris, garbage, personal property, fixtures or other items which it deems to <br /> violate law or regulation, and dispose of these items as it deems fit, <br /> repair, fix, rehabilitate any item or fixture which violate law or regulation, and <br /> which appear the attached list of 14 items; and however, <br /> iii. this license specifically excludes the City from: <br /> a. removing horse trailers, <br /> b. removing vehicles which are in working condition and otherwise stored <br /> appropriately, <br /> -2- <br />
