City of Centerville <br />Planning and Zoning Commission <br /> <br />October 2, 2012 <br /> <br />III.OLD BUSINESS <br />. <br /> <br />1. Snowmobile Regulations. <br /> <br />The Commission reviewed a draft of the proposed snowmobile ordinance that has been <br />modified with recommendations from the City attorney. Administrator Larson pointed out <br />that the ordinance is likely to be approved by the cities of Circle Pines, Lexington and Lino <br />Lakes, although no action has been taken there yet. The Commission discussed hours of <br />operation and whether the more relaxed hours would result in complaints. After some <br />discussion it was determined that the ordinance should be forwarded to Council to be <br />implemented before the snow season. <br /> <br />Motion by Commissioner Wood, seconded by Commissioner Koski to recommend <br />that the City Council adopt the ordinance regulating snowmobiles. All in favor. <br />Motion carried unanimously. <br /> <br />2. Ord. #XX, Second Series Amending City Code, Chapter 156, Section 156.016 <br /> – 156.052 & Zoning Districts by Grid. <br /> <br /> <br />The Commission received a report from City Attorney Glaser regarding the modifications <br />to Chapter 156, zoning. Mr. Glaser reviewed the needed definitions and then explained the <br />issues surrounding the group living and day care uses. These are regulated in many <br />respects by State Law and the city does not have a choice but to allow these uses in <br />residential districts, although conditions could apply to some of these. <br /> <br />Glaser review the issues related to Group Homes for Treatment of Juvenile Sex Offenders. <br />The Commission discussed this at length. The Commission determined that the city has a <br />duty to protect children and discussed what distance might be reasonable to keep these <br />uses from locations where children and other vulnerable persons would gather. <br /> <br />Motion by Commissioner Larson, seconded by Commissioner Koski to approve the <br />attached findings and recommendation to adopt the amendments to Chapter 156. <br />All in favor. Motion carried unanimously. <br /> <br /> <br />IV.NEW BUSINESS. <br /> <br /> <br />1. Meeting date for November conflicts with General Election. <br /> <br />Consensus of the commission was to set the date for the second Tuesday in November, <br />provide that if there is no business needing action, the meeting would be cancelled. <br /> <br /> <br />V.DISCUSSION ITEMS: <br /> <br /> <br />Outside solid fuel heaters. <br /> Administrator Larson reported that some communities have <br />determined to regulate outside heating devices. They can be a nuisance producer of smoke <br />and other emissions. Consensus was not to do anything at this time, but the administrator <br />would check with neighboring communities to see if they plan to regulate the devices. <br />Page 2 of 3 <br /> <br />
