Uniform BUilding Code <br />It is aranabIe that several provisions of the 1997 Uniform Building <br />Code could be used to authorize access, testina, and compel the <br />cleanup of contamina'Ced structures. Various provisions allow the <br />following: <br />i. Authorize building official to eDter site.65 <br />it Require premises to be tested. 66 <br />iii. Declare building in which lab is f01lnd to be a public <br />nuiSlDce.6' <br />iv. Prohibit access unti1strl1cture is safe for human occupation.151 <br /> <br />b. Uniform Housing Code <br />Like the Uniform Building Code, it is arguable that the Uniform <br />Housing Code cou.ld be used to achieve the cleanup of contaminated <br />housing. Various provisions of this code allow the following actions: <br />i. Enter a buildina.69 <br />ii. Declare a building to be a nuisapcc.70 <br />iii. Declare a nuisaDce building to be a "substandard buildins.",1 <br />iv. Cause the repair, rehabilitation, vacation or demolition althe <br />builetins.'2 <br />v. Hold landowners and/or occupants personally and financially <br />liable for violations. 73 <br /> <br />o. City Nuisance Ordinance. <br />d. City Zoning Ordin8llcos prohibiting nuisances and/or blight. <br />e. City Trespus Ordinance to prohibit re-entry into structure after lab has <br />been seized md before cleanup is complete. <br />f.
