He then asked whether it <br />would be possible to obtain partial building permits to allow for footings and foundations. <br /> <br />Council Member Lee indicated he was not ready t<;> put the City at any kind of risk to <br />save a week or two of building time. He also indicated he does not want to create a <br />precedence of ignoring the City's ordinances. <br /> <br />Council Member Paar agreed and said that he does not want to have to deal with a <br />situation where, even though a slim chance, the documents are not right and require <br />amendments and building permits are already issued. <br /> <br />Council Member Broussard Vickers indicated that, if she felt the City had more <br />culpability in the delay, she would be more inclined to consider the request but she does <br />not feel the City had anything to do with the delay. She further commented that the City <br />has a law on the books that cannot be waived. <br /> <br />Mr. Runkle indicated that he has worked in a number of other metro communities that <br />allow building permits to be issued with just the receipt from the recorder's office. <br /> <br />Council Member Broussard Vickers indicated that the City's Ordinance is not written this <br />way and noted that. this is the first time this has been an issue during her five years on <br />Council. <br /> <br />Mayor Sweeney indicated it was the consensus of Council that Council was not interested <br />in waiving the City's ordinance to allow for building permits prior to recorded <br />documents. <br /> <br />2. Pheasant Marsh Phase III - Ground Development's Request to Start Phase ill <br /> <br />Mayor Sweeney indicated he did not have any issues with allowing Phase III to begin <br />early but noted it would require a Comprehensive Plan amendment that the developer <br />would need to pay for. <br /> <br />Council Member Capra indicated she was concerned that the Comprehensive Plan has not <br />been amended and that should be done first. City Attorney Hoeft indicated that Ground <br />Development was seeking approval to move forward with Phase III before spending any <br />money on a Comprehensive Plan amendment. <br /> <br />City Attorney Hoeft indicated that he is concerned with the fact that the improvements <br />for Phase I and Phase II are close to the $1.8 million listed in the developer's agreement. <br />He then said that if the improvements go over that $1.8 million the developer has the <br />right to challenge those amounts and the City would be charged with proving the benefit <br />of those improvements and may be left with a sizeable bill to pay. <br /> <br />Page 4 of 11 <br />
