<br />CITY OF CENTERVILLE <br />ANOKA COUNTY, MINNESOTA <br /> <br />SUMMARY OF ORDINANCE ##90 <br /> <br />NonCE IS HEREBY GIVEN that, on February 22, 20061 Ordinance #90, entitled "AN <br />EMERGENCY INTERIM ORDINANCE TEMPORARILY PROHIBITING CERTAIN <br />DEVELOPMENT IN THE AREA GENERALLY KNOWN AS THE DOWNTOWN 01' <br />CENTERVILLE" was adopted by the City Council of the City ofCenterville, Minnesota. <br /> <br />NOTICE IS FtJRllIbt GIVEN that, because of the lengthy nature of Ordinance #90, the <br />City Council has directed that a title and .lmm'-'Y be prepared for publication pursuant to MinD. <br />Stat. 412.191, Subd4. <br /> <br />NOTICE IS FURTHER GIVEN that a complete, printed copy of Ordinance #90 is <br />available for inspection by any person during regular office hours at the office of the City Clerk, <br />1880 Main Street, Centerville, MN. <br /> <br />NOTICE IS F1JR~11ID( GIVEN that the general pwpose oCthe ordinance is to establish a <br />moratorium on development in the area commonly known as the downtown, until August 14, 2006, <br />wbile the city studies the area IIld determines the appropriate use and establishes an use plan and <br />zoning regulations to implement such planning study. <br /> <br />Sedlen 1~ <br />This section provides background and identifies the need for a study to identify current uses <br />and determine recommendations for the use or reuse of parcels in the study area. <br />Section 2. <br />This section establishes definitions for various terms used in the ordinance and identifies the <br />geographic area "Study Area" covered by the moratorium. <br />Section 3. <br />This section establishes a temporary moratorium on plats and building permits for <br />enlargements of existing uses within the downtown study area. <br />Section 4. <br />This section provides for the mechanism for enforcement of the ordinance, including <br />injunction and other civil remedies in court. <br />~D15 <br />Section S provides that sections of the ordinance shall be separable for one another in the <br />event that any part would be invalidated by a court. <br />Seedon 6. <br />The ordinance is effective on passage and provides that the duration of the ordinance shall <br />be until the adoption of official controls contemplated by 'the ordinance or until August 1 S, 2006, <br />whichever is earlier. <br /> <br />92144 <br /> <br />6P <br />
