The Plat shall be developed in accordance with the <br /> <br />following plans ("Plans") which are on file with the City. The Plans shall not be attached to this <br /> <br />Agreement. If the Plans vary from the written terms of this Agreement, the written terms shall <br /> <br />control. The Plans are: <br /> <br />Plan A - Hunter's Crossing 3rd Addition final plat dated (pending <br />County review). <br />Plan B - Final Grading and Erosion Control Plan dated February 10, 2005 prepared <br />by Matke Survey and Engineering ("Grading Plan"). <br />Plan C - Soils Investigation Report dated December 1, 2005 prepared by Stork <br />Twin Cities T~sting.. <br /> <br />7. CITY INSTALLED IMPROVEMENTS. The City shall install and Developer <br /> <br />shall pay for the following improvements ("Improvements") as required by the Construction <br /> <br />. Plans: <br /> <br />A. Sanitary Sewer System <br />B. Water System <br />C. Storm Sewer <br />D. Streets <br />E. Concrete Curb and Gutter <br />F. Sidewalks and Trails <br /> <br />The Develope~ hereby requests that the City install the necessary streets, sanitary sewer, <br /> <br />water, municipal storm sewer, and walkway/trail to service the proposed development. <br /> <br />The City agrees to proceed pursuant to .Minnesota Statutes Chapter 429, the Petition and <br /> <br />Waiver of Irregularity and Appeal signed by Developer dated ~~~~~, ~t\t\\o ' and <br /> <br />to specially assess 100% of the cost of said improvements together with design and <br /> <br />construction engineering, to the subject property.
