Res. #13 -0 <br /> A RESOLUTION AUTHORIZING CITY PARTICIPATION IN RESOLVING <br /> PRIVATE STORM DRAINAGE PROBLEMS <br /> WHEREAS, there are a number of areas in the city where grades are inadequate to <br /> properly drain residential properties resulting in standing water and unusable yards, and <br /> WHEREAS, the drainage problems are usually through no fault of the property owners, <br /> and <br /> WHEREAS, some of these circumstances can be alleviated through installation of drain <br /> tile systems or other drainage facilities installed in the drainage easements that exist on <br /> the property, and <br /> WHEREAS, these problems often affect numerous properties and cannot be effectively <br /> resolved by any one property owner, and <br /> WHEREAS, even though these problems are often cosmetic and do not present a danger <br /> of property damage through flooding, the public good may be served by removing <br /> standing water and the associated nuisances. <br /> NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF <br /> CENTERVILLE, MINNESOTA: <br /> 1) The Council authorizes staff to work with groups of property owners to resolve the <br /> private drainage issues where it is possible to do so by constructing drainage facilities <br /> in public easements. <br /> 2) The council authorizes participation in the cost of these structures by sharing in 25% <br /> of the cost of the project to be paid from the Stormwater Fund, provided the property <br /> owners agree to voluntarily be assessed for the remaining 75% of the cost, and further <br /> provided that the maximum city -share participation in these kinds of projects is <br /> limited to $10,000 in any calendar year and a portion of the fund's budget shall be <br /> reserved for this purpose. <br /> 3) The City Council hereby authorizes financing of the property owner share through <br /> voluntary special assessment agreements, such financing for a maximum of five years <br /> at 4.5% interest. <br /> Adopted by the City Council this 9th day of October, 2013. <br /> Tom Wilharber, Mayor <br /> Attest: <br /> Teresa Bender, City Clerk <br />
