WHEREAS, the Parties have a mutual public interest in the outcome of said lawsrlit Lake Level Lawsuit because it has the potential of affecting their municipal water supplies. WHEREAS, through this Joint Powers Agreement, the Parties intend to pool their resources to jointly protect their mutual public interests with regard to the - -lawsuit Lake L evel Lawsuit NOW THEREFORE, the Parties agree, as follows: 1. Purpose. The purpose of this Joint Powers Agreement is to create a formal coalition of the Parties to intervene in the4awsuit Lake Level Lawsuit to retain and pay for legal counsel, to engage and pay for scientific experts, to coor dinate_lo__bby in¢ a nd publ relatio efforts regarding the subject matter othhe Lake Level_Lawsuit, to establish a method to determine tactical decisions with regard to the lawsuit- Lake Level L awsuit and to establish a formula to pay for the costs of the coalition. _ 2. Name. The coalition established by this Agreement shall be known as the Northeast Municipal Water Utility Coalition (NEMWUC), or s ome ot her_name determined_by the Parties.: 3. Term of Aareement/Termination 3.1 This Agreement shall continue for as long as the lawsuit -Lake Level Lawsuit and any appeals continue or until terminated by a vote of a majority of the Parties. 3.2 Any party may withdraw from this Agreement by giving the other parties at least 30 days written notice sent to the manager /administrator of each of the other parties. 4.
