WHEREAS, the Parties have a mutual public interest in the outcome of said lawsrlit Lake <br /> Level Lawsuit because it has the potential of affecting their municipal water supplies. <br /> WHEREAS, through this Joint Powers Agreement, the Parties intend to pool their resources <br /> to jointly protect their mutual public interests with regard to the - -lawsuit Lake L evel Lawsuit <br /> NOW THEREFORE, the Parties agree, as follows: <br /> 1. Purpose. <br /> The purpose of this Joint Powers Agreement is to create a formal coalition of the <br /> Parties to intervene in the4awsuit Lake Level Lawsuit to retain and pay for legal <br /> counsel, to engage and pay for scientific experts, to coor dinate_lo__bby in¢ a nd publ <br /> relatio efforts regarding the subject matter othhe Lake Level_Lawsuit, to establish a <br /> method to determine tactical decisions with regard to the lawsuit- Lake Level L awsuit <br /> and to establish a formula to pay for the costs of the coalition. _ <br /> 2. Name. <br /> The coalition established by this Agreement shall be known as the Northeast <br /> Municipal Water Utility Coalition (NEMWUC), or s ome ot her_name determined_by <br /> the Parties.: <br /> 3. Term of Aareement/Termination <br /> 3.1 This Agreement shall continue for as long as the lawsuit -Lake Level Lawsuit <br /> and any appeals continue or until terminated by a vote of a majority of the <br /> Parties. <br /> 3.2 Any party may withdraw from this Agreement by giving the other parties at <br /> least 30 days written notice sent to the manager /administrator of each of the <br /> other parties. <br /> 4.
