City of Centerville Council Meeting Minutes July 23,2014 Mayor Wilharber opened the Public Hearing at 6:42 p.m. IV. PUBLIC HEARING 1. Mr. & Mrs. Stan Hasiak, 6994 Centerville Road — Appeal the Designation of Dog as Potentially Dangerous Centennial Lakes Police Chief James Coan appeared before Council and stated that on June 17, 2014 Community Service Officer Fredrickson was called to receive a dog bit complaint from a gentleman that had been chased by two (2) German Shepard dogs belonging to the Hasiak's and bit by one (1) and his clothing being nipped at by the other. Chief Coan stated that this evening is to determine whether or not to determine if the dog that bit (Szaryk) be deemed Potentially Dangerous. Ms. Stephanie Hasiak appeared before Council to appeal the designation of Szaryk as being Potentially Dangerous. Ms. Hasiak stated that all requirements for a dog of this designation have been met including a newly installed fence. CSO Fredrickson stated that at the time of this incident, the Hasiak's had not been following proper enclosure requirements for the already deemed Potentially Dangerous dog Heidi. CSO Fredrickson stated that snowfencing had been installed in one area rather than the same material that is utilized throughout the remainder of the yard and that has recently been replaced with a more permanent fencing material with a gate. Ms. Hasiak stated that it was not the intent to let the animals out,they just got out during a period that her husband was getting ready to leave. Attorney Glaser reviewed the requirements for a dog that is deemed Potentially Dangerous by stating that the owners must provide proper enclosure, the dog must be muzzled when outside of that enclosure and on a leash not exceeding six (6) feet, be micro chipped and be annually registered with the City. Council had confusion regarding which dog had bit during this incident and the deeming of Potentially Dangerous of the other dog. Administrator Larson stated that there were two recent incidents where dogs had bitten but they were two (2) separate incidents with two (2) separate dogs and owners. Administrator Larson stated that Hasiak's other German Shepard name Heidi had been deemed Potentially Dangerous in 2009 following a bite incident. Lengthy discussion ensued regarding the Hasiak's routine with the dogs, leaving their home and gated area, transferring them from the basement to outdoors, rehoming of Heidi, $300,000 liability insurance requirement, deeming of Dangerous versus Potentially Dangerous. Council Member Paar questioned whether either of these two dogs had been involved with an additional incident several weeks prior. Chief Coan stated that he was unaware of additional incidents but would research the item. Mayor Wilharber closed the Public Hearing at 7:08 p.m. Page 2 of 7 P2
