City of Centerville Council Meeting Minutes February 25,2015 City Attorney Glaser stated that he added the very last bullet point "The unique impact on the City of Centerville from this settlement includes the potential use of the Saint Paul Regional Water Service facilities located in Centerville to pump water out of Centerville Lake to serve the region's needs. The drawdown of Centerville Lake could have negative environmental impacts." Council Member King requested that language be added that the Metropolitan Council designed the regional water supply project and Council concurred. Administrator Ericson stated that if Council desired Staff would forward the resolution to legislators, Metropolitan Council, Minnesota Department of Natural Resources and local representatives from neighboring communities. _Motion by Council Member Kinn, seconded by Council Member Love to Approve Res #15-008 and its forwarding to aporouriate entities. All in favor. Motion passed 3. Reaffirming Final Plat, 6995 — 2& Avenue South with Promissory Note for Park Dedication Fees Lot 1 ($3,806,Center Villa,Second Addition) Attorney Glaser stated that the Lessard's had been given 60 days to file the approved plat,they did not do so due to the existing tenant's financing falling through. Attorney Glaser stated that another buyer is in place,the plat needs to reaffirmed and a requirement of the reaffirmation was that park dedication fees be paid in the amount of$3,860. Attorney Glaser also stated that the Lessard's have requested that they be allowed to enter into the submitted Promissory Note rather than paying the fees up front. Attorney Glaser stated that if the Lessards' fail to comply with the Promissory Note, a lien will be placed against the proceeds of the sale and if a sale does not occur,the$3,860 will be assessed to their property taxes commencing 2016. Administrator Ericson stated that Mechanical Air Systems, Inc.,an HVAC company, has shown interest in the property and has submitted for a Conditional Use Permit. Administrator Ericson also stated that the Planning & Zoning Commission would be considering scheduling a public hearing at their next meeting. Administrator Ericson stated that Mechanical Air Systems,Inc. is a reputable company with fourteen(14) employees, Miller Mobile Marine will unfortunately be vacating the property at the end of April and staff has met with the potential buyers regarding their use of the building,outside storage and fire suppression requirements which are not needed. _Motion was made by Council Member Fehrenbacher, seconded by Council Member Love Lo reaffirm Council's orevious approval for Final Plat of 6995 — 20t Avenue South as submitted and Promissory Note for Park Dedication Fees 33,860 for Lot 1 Center Villa. Second Addition as presented. All in favor. Motion carried 4. CSAH21/Centerville Street Reconstruction — St. Paul Regional Water Agreement (6* Rider)Allowing for 48"Culvert Installation&Maintenance Administrator Ericson stated that it is critical that this agreement is completed allowing the City's replacement of the culvert that is in disrepair on their property. Engineer Statz stated that Legal Counsel and himself had been working with Mr. Bill Tsehida, Unit Supervisor, St. Paul Regional Water Services to obtain an agreement to allow for the replacement.
