I received a reply from Scott Lepak about the consolidation vs merger question He reviewed the contracts and says that since they don't specifically allow the employers to "contract out" the work of the employees, we would have to negotiate with the unions before we could terminate the departments. We have to negotiate about the effects of the action on employees, even if the contracts are expiring He said it makes things easier if 1) we are forming a joint powers agreement and 2) if we terminate all employees at midnight and the new agency does the hiring and 3) we hire some folks from outside In any case, if this looks like it's going forward, we had better get him or someone with his credentials on board fairly soon because things could get sticky in rapid order Kim, at the public hearing at Centerville, someone brought up the question, "What if a member city cannot pay its share of the operations?" I think your attorney said something to the effect the others would have to pay the whole bill because they wouldn't be able to deny coverage to the non-payer. Does anyone know the details or can we find them out? My committee reps raised the question See you all Thursday. What do you think? I purposely put an end time on the agenda so that there is a sense of the need to get decisions made quickly and decisively.
