RESOLUTION NO. 9.03 <br /> RESOLUTION AUTHORIZING AND DIRECTING THE ACQUISITION OF <br /> CERTAIN REAL PROPERTY INTERESTS FOR THE DEVELOPMENT OF <br /> THE WEST TWO-THIRDS OF LOTS 8, 9, 10, 11 and 12, BLOCK 4, <br /> CENTERVILLE, ANOKA COUNTY, MINNESOTA THROUGH THE EXERCISE <br /> OF EMINENT DOMAIN <br /> WHEREAS, the School Board of Independent School District No. 12, Centennial <br /> ("School Board") is the official governing body of Independent School District No. 12. <br /> Centennial (the "District"); and <br /> WHEREAS, the District, a Minnesota municipal corporation acting by and <br /> through its School Board, is authorized by law to acquire land and other interests in real <br /> estate which are needed for public use or purpose; and <br /> WHEREAS, the property described in Exhibit A attached hereto ("Affected <br /> Property') abuts property owned by the District; and <br /> WHEREAS, the District is in need of additional parking space for the operation <br /> of the school located on said District property, and the District does not currently have <br /> sufficient land within the District property to adequately meet the need; and <br /> WHEREAS, agents or employees of the District have met with the owner of the <br /> AfTected Property in an effort to reach an agreement upon terms and conditions under <br /> which the School District may acquire title to the Affected Property; and <br /> WHEREAS, the District has obtained an appraisal of the Affected Property, has <br /> provided the appraisal to the owner of the Affected Property, and has offered to acquire <br /> the Affected Property for an amount in excess of the appraised value in an effort to avoid <br /> the need to utilize its Eminent Domain authority; and <br /> WHEREAS, to date. representatives of the District have been unable to reach an <br /> agreement with the owner of the Affected Property on the terms and conditions of a <br /> voluntary acquisition; and <br /> WHEREAS, the School Board finds that it is reasonably necessary. proper, and <br /> convenient. and in the interest of the public health. public safety. and general welfare of <br /> the District that title to and possession of the Affected Property as described in Exhibit A <br /> be acquired through use of the power of eminent domain; and <br /> Page 1 of 2 EXHIBIT <br /> 1 <br /> 23 <br />
