ARTICLE 20 - CONTRACT SECURITY AND INSURANCE <br /> 20.01 Article 5 of the General Conditions, as may be modified by the Supplementary Conditions, sets <br /> forth Owner's requirements as to performance and payment bonds and insurance.When the <br /> successful Bidder delivers the executed Agreement to Owner, it shall be accompanied by <br /> such bonds. <br /> ARTICLE 21 - SIGNING OF AGREEMENT <br /> 21.01 When Owner issues a Notice of Award to the successful Bidder, it shall be accompanied by <br /> the required number of unsigned counterparts of the Agreement along with the other <br /> Contract Documents which are identified in the Agreement as attached thereto.Within 15 <br /> days thereafter, successful Bidder shall sign and deliver the required number of counterparts of <br /> the Agreement and attached documents to Owner.Within 10 days thereafter, Owner shall <br /> deliver 2 fully signed counterparts to successful Bidder with a complete set of the Drawings <br /> with appropriate identification. <br /> ARTICLE 22-RESPONSIBLE CONTRACTOR <br /> 22.01 In accordance with Laws of Minnesota, 2014, chapter 253 (Minnesota Statutes §16C.285), <br /> Bidders are hereby advised that the Owner cannot award a construction contract in excess of <br /> $50,000 unless the contractor is a "responsible contractor" as defined in Minnesota Statutes <br /> §16C.285, subdivision 3. A bidder submitting a Proposal for this Project must verify that it meets <br /> the minimum criteria specified in Minnesota Statutes §16C.285, subdivision 3, by completing <br /> the Responsible Contractor Certificate within this Proposal.Statements in the certificate must <br /> be certified by a company officer. Bidders are responsible for obtaining verifications of <br /> compliance from all subcontractors, using a form provided by the Owner. A bidder must <br /> submit signed verifications from subcontractors upon the Owner's request. <br /> A Bidder or subcontractor who does not meet the minimum criteria established in Minnesota <br /> Statutes§16C.285, subdivision 3, or who fails to verify compliance with the minimum <br /> requirements,will not be a "responsible contractor" and will be ineligible to be awarded the <br /> Contract for this Project or to work on this Project. Bidders and subcontractors are also advised <br /> that making a false statement verifying compliance with any of the minimum criteria will <br /> render the Bidder or subcontractor ineligible to be awarded a construction contract for this <br /> Project and may result in the termination of a contract awarded to a Bidder or subcontractor <br /> that makes a false statement. <br /> ARTICLE 23-SUBLETTING OF CONTRACTOR <br /> 23.01 REVISED 11/24/14 <br /> The provisions of MnDOT 1801 are modified as follows: <br /> For Projects in excess of $50,000, the Contractor may sublet work only to subcontractors that <br /> meet the definition of "responsible contractor In Minnesota Statutes §16C.285, subdivision 3. <br /> The Contractor is responsible for obtaining verifications of compliance with §16C.285 from <br /> subcontractors using a form provided by the Owner.
