JOINT POWERS AGREEMENT <br /> BETWEEN THE CITY OF LINO LAKES <br /> AND THE CITY OF CENTERVILLE <br /> REGARDING MAINTENANCE OF WEST CEDAR STREET <br /> THIS AGREEMENT is made and entered into on the latest date set forth below by and <br /> between the City of Centerville and the City of Lino Lakes, governmental subdivisions of <br /> the State of Minnesota. <br /> RECITALS <br /> 1. West Cedar Street east of 20th Avenue S. is a line road that is on the border <br /> between Lino Lakes (to the south) and Centerville (to the north) with the center <br /> line of the Street, as platted, as the corporate boundary. <br /> 2. The City of Centerville participated with the City of Lino Lakes when it paved <br /> West Cedar Street from 201h Avenue S. (CSAH 54) eastward approximately 1,650 <br /> feet pursuant to a Joint Powers Agreement. <br /> AGREEMENT <br /> In consideration of the mutual undertakings expressed herein, Lino Lakes and Centerville <br /> agree as follows: <br /> 1. Purpose. The purpose of this Agreement is to set forth the terms of the agreement <br /> between Lino Lakes and Centerville to maintain West Cedar Street east of 20th <br /> Avenue South until such time as it becomes necessary to reconstruct this section <br /> of street. <br /> 2. Division of Cost. <br /> a. A City is obligated to pay a debt under this Agreement only if it approves <br /> the cost or estimated cost of work performed pursuant to this Agreement <br /> before work is performed or any cost is incurred. <br /> b. Centerville shall perform snow plowing and winter sanding/de-icing at its <br /> sole expense. <br /> c. Each City shall inspect and maintain the storm water drainage system <br /> within its boundaries. <br /> d. Each City is responsible for the following on its respective side of West <br /> Cedar Street: <br /> i. Erecting and maintaining appropriate signage. <br /> ii. Cutting, trimming or removing brush and trees. <br />
