3.6.3 The Grantee shall install and maintain such devices as will apprise or warn <br /> Persons and governmental entities using the Rights-of-Way of the existence of <br /> work being performed on the System in Rights-of-Way. <br /> 3.6.4 The Grantee shall be a member of the One Call Notification System (otherwise <br /> known as "Gopher State One Call") or its successor, and shall field mark the <br /> locations of its underground facilities upon request. Throughout the term of this <br /> Franchise,the Grantee shall identify the location of its facilities for the City or the <br /> Commission at no charge to the City or the Commission. <br /> 3.7 Removal of Facilities at Expiration of Franchise. <br /> At the expiration of the term for which this Franchise is granted, or upon the expiration of <br /> any renewal or extension period which may be granted, the City shall have the right to <br /> require the Grantee, at the Grantee's sole expense: (i) to remove all portions of the <br /> System from all Rights-of-Way within the City; and (ii) to restore affected sites to their <br /> original condition, unless Grantee, or its affiliate, has a separate authorization from the <br /> City to occupy the City's Rights-of-Way. Should the Grantee fail, refuse or neglect to <br /> comply with the City's directive, all portions of the System, or any part thereof, may at <br /> the option of the City become the sole property of the City, at no expense to the City, or <br /> be removed, altered or relocated by the City at the cost of the Grantee. The City shall not <br /> be liable to the Grantee for damages resulting from such removal, alteration or relocation. <br /> SECTION 4. DESIGN PROVISIONS <br /> 4.1 System Facilities and Equipment. <br /> 4.1.1 Grantee shall develop, construct and operate a state-of-the-art cable <br /> communications system, constructed in accordance with Section 2.8.1, which <br /> shall have at least the following characteristics: <br /> 4.1.1.1 A modern design when built, utilizing an architecture that will <br /> permit additional improvements necessary for high-quality and <br /> reliable service throughout the Franchise term, and the capability <br /> to operate continuously on a twenty-four (24) hour a day basis <br /> without severe material degradation during operating conditions <br /> typical to the Minneapolis/St. Paul metropolitan area; <br /> 4.1.1.2 Standby power generating capacity at the headend. The Grantee <br /> shall maintain standby power generators capable of powering all <br /> headend equipment for at least twenty-four (24) hours. The back- <br /> up power supplies serving the System shall be capable of providing <br /> power to the System for not less than three (3) hours per <br /> occurrence measured on an annual basis according to manufacturer <br /> specifications in the event of an electrical outage.
