construction; (ii) areas where construction crews will be working; and (iii) any <br /> expected temporary interruptions to existing services which may occur. <br /> 4.3 System Maintenance. <br /> 4.3.1 The Grantee shall interrupt Cable Service only for good cause and for the shortest <br /> time possible. Such interruption shall occur during periods of minimum use of <br /> the System. The Grantee shall use its best efforts to provide the Commission with <br /> at least twenty-four (24) hours prior notice of a planned service interruption, <br /> except for a planned service interruption which will have a minimal impact on <br /> Subscribers, usually meaning affecting less than one hundred (100) Subscribers or <br /> less than a fifteen(15)minute interruption. <br /> 4.3.2 Maintenance of the System shall be performed in accordance with the applicable <br /> technical performance and operating standards established by FCC rules and <br /> regulations. Should the FCC choose to abandon this field and does not preempt <br /> the City's entry into this field, the City may adopt such technical performance and <br /> operating standards as its own, and the Grantee shall comply with them at all <br /> times. <br /> 4.4 System Tests and Inspections; Special Testing. <br /> 4.4.1 Grantee shall perform all tests necessary to demonstrate compliance with the <br /> requirements of the Franchise and other performance standards established by <br /> applicable law or regulation. <br /> 4.4.2 The City and the Commission shall have the right to inspect all construction or <br /> installation work performed pursuant to the provisions of the Franchise. In <br /> addition, the City and/or the Commission may require special testing of a location <br /> or locations within the System if there is a particular matter of controversy or <br /> unresolved complaints regarding System construction, operations or installation <br /> work pertaining to such location(s). Such tests shall be limited to the particular <br /> matter in controversy. The City and/or the Commission shall endeavor to so <br /> arrange its request for such special testing so as to minimize hardship or <br /> inconvenience to the Grantee or to the Subscribers of such testing. <br /> 4.4.3 Before ordering such tests, the Grantee shall be afforded thirty (30) days <br /> following receipt of written notice to investigate and, if necessary, correct <br /> problems or complaints upon which tests were ordered. The City and/or the <br /> Commission, as applicable, shall meet with the Grantee prior to requiring special <br /> tests to discuss the need for such and, if possible, visually inspect those locations <br /> which are the focus of concern. If, after such meetings and inspections, the City <br /> and/or the Commission wishes to commence special tests and the thirty (30) days <br /> have elapsed without correction of the matter in controversy or resolution of <br /> complaints, the tests shall be conducted at the Grantee's expense by a qualified <br /> 21 <br />
