engineer selected by the City and/or the Commission, as applicable, and the <br /> Grantee shall cooperate in such testing. <br /> 4.4.4 Unless otherwise provided in this Franchise, tests shall be supervised by the <br /> Grantee's chief technical authority, or designee, who shall certify all records of <br /> tests provided to the City and the Commission. <br /> 4.4.5 The Grantee shall provide the City and the Commission with at least two (2) <br /> business days' prior written notice of, and opportunity to observe, any tests <br /> performed on the System as it specifically relates to cable service. <br /> 4.4.5.1 Test results shall be filed with the City and the Commission within <br /> fourteen(14) days of a written request by the City and/or the Commission. <br /> 4.4.5.2 If any test indicates that any part or component of the System fails to meet <br /> applicable requirements, the Grantee, without requirement of additional <br /> notice or request from the City or the Commission, shall take corrective <br /> action, retest the locations and advise the City and the Commission of the <br /> action taken and the results achieved by filing a written report certified by <br /> the Grantee's chief technical authority, or designee. <br /> 4.5 Drop Testing and Replacement. <br /> The Grantee shall replace, at no separate charge to an individual Subscriber, all Drops <br /> and/or associated passive equipment incapable of passing the full System capacity at the <br /> time a Subscriber upgrades. <br /> 4.6 FCC Reports. <br /> Unless otherwise required by the terms of this Franchise, the results of any tests required <br /> to be filed by Grantee with the FCC or in the Grantee's public file, as it relates to cable <br /> service pursuant to this Franchise, shall upon request of the City or the Commission also <br /> be filed with the City or the Commission, as applicable, within ten (10) days of the <br /> request. <br /> 4.7 Lockout Capability. <br /> Upon the request of a Subscriber, the Grantee shall make lockout capability available at <br /> no additional charge, other than a charge for a Set Top Box. <br /> 4.8 Types of Service. <br /> Any change in programs or services offered shall comply with all lawful conditions and <br /> procedures contained in this Franchise and in applicable law or regulations. <br /> 22 <br />
