<br />1\ <br /> <br />',~ <br />''<v~ <br />"..f\U <br />,\1 <br />;Yv~ <br />'( <br />-~ <br />IY1) <br />"'-1 <br /> <br />f<. <br /> <br />REFUSE & RECYCLING SERVICE CONTRACT <br /> <br />THIS CONTRACT made and entered into on February 1st, 2003, by and between the City of <br /> <br />Centerville, Minnesota, a municipal corporation in the County of Anoka (City), and Waste Management <br /> <br />of Minnesota, Inc., a Minnesota corporation (Contractor). <br /> <br />RECIT ALS: <br /> <br />WHEREAS, the City requires the collection and disposal of garbage and rubbish, yard waste, and <br /> <br />recyclables from residences in the City; and <br /> <br />Whereas, the Contractor is a licensed hauler in the City engaged in the business of collection and <br /> <br />disposing of garbage and rubbish, yard waste, and recyclables; and <br /> <br />Whereas, the City desires to obtain the services of the Contractor and the Contractor desires to <br /> <br />provide services to the City. <br /> <br />NOW, THEREFORE, in consideration of the mutual undertakings of the parties, it is agreed: <br /> <br />I. GENERAL DESCRIPTION OF SERVICES. The Contractor will supply the labor, materials, and <br />equipment necessary to make a complete collection of garbage, refuse, and yard waste and <br />recyc1ables from all residences in the City during the term of this Contract. Such collections will <br />include all residential dwelling units, as defined in Section ill K, and be accomplished by use of <br />individual containers. The Contractor will provide the personnel, equipment, and facilities necessary <br />to fulfill the terms and conditions of this Contract. The Contractor will provide the services in <br />compliance with all applicable laws and charge for the services on a volume-based schedule in <br />accordance with Attachment A. <br /> <br />II. TERM OF CONTRACT. This Contract is effective for the seven-year period beginning February <br />1, 2003, and expiring December 31, 2009, with an option to renew not exceeding five one-year <br />periods. <br /> <br />III. DEFINITIONS. For purposes of this Contract, the terms defined in this Section have the meanings <br />given them: <br /> <br />A. Additional Collection Service. Refuse in excess ofthe designated volume-base per residential <br />dwelling unit. <br /> <br />-1- <br />
